Ute Off the Road: Tradie Downtime After a Crash

If your ute is in the panel shop after a crash that was not your fault, you can usually keep working in a like-for-like replacement ute while the at-fault insurer sorts itself out. The replacement is arranged through credit hire, which means you do not pay upfront, and the claim is recovered from the insurer that should have paid.
This guide is for Sydney tradies, fleet managers and the repairers and brokers who refer them. It covers what a work ute actually has to carry, how towing and trays work on a replacement, how to keep clients and builders informed, and what happens when the repair runs past the quoted date.
Key takeaways
- A work ute off the road is a lost day rate, not just lost transport, so the replacement has to match the job.
- Like-for-like means payload, tray length, towing capacity, seating and access, not just a ute of any kind.
- Credit hire means you do not pay upfront; the cost is recovered from the at-fault insurer.
- Tell builders and clients early with a firm date, and keep a written record of the revised program.
- Get the repair delay reason in writing and tell the credit hire provider the same day the timeline slips.
- The ute is the business, not just the transport
- What a like-for-like ute needs to carry
- Towing, trays and toolboxes on a replacement
- Getting the replacement to the job site
- Talking to builders and clients about delays
- Keeping the claim moving while you work
- When the repairer needs the ute longer than quoted
- Handing the replacement back at the end
- What this means for fleet managers and referrers
The ute is the business, not just the transport
For a lot of Sydney trades, the ute is the whole operation. It carries the tools, the ladder, the conduit, the sample boxes and the paperwork. Take it away and the business stops earning, not just moving. A chippie based in Marrickville with a job in Breakfast Point does not lose a car; they lose the day rate, the apprentice's productive hours and the goodwill of a builder who has three other trades waiting on them.
The losses stack up fast. There is the quoted job that has to be pushed. There is the variation you cannot get to because you are at the depot sorting out a hire car that does not fit a 1.8 metre ladder. There is the client who calls at 7am on a Tuesday to ask why nobody is on site. None of that appears on an insurer's first offer.
Under the principle in Arsalan v Rixon, a person who has lost the use of a vehicle through another driver's negligence can generally recover the reasonable cost of a substitute. For a work ute, that is not a Corolla. It is a ute that can do the work the damaged one was doing.
If you have just been hit, the first 24 hours matter more than most people realise. Read what to do in the first 24 hours after a not-at-fault crash before you agree to anything with the other side's insurer.
What a like-for-like ute needs to carry
Like-for-like for a tradie is not about the badge. It is about payload, tray length, towing capacity, seating and whether the thing can actually get into the sites you work on. A single-cab trayback and a dual-cab Wildtrak are not interchangeable if you carry four people and a 2.5 tonne trailer.
Before you accept a replacement, write down what your ute does in a normal week. That list is what the replacement has to match.
- Payload and tray length: can it take the toolbox, the sheets and the compressor at once?
- Towing: braked capacity, tow bar rating and whether a trailer plug and brake controller are fitted.
- Cab layout: single, extra or dual cab, and how many seats you actually fill.
- Access: roof height for car parks at hospitals and shopping centres, and turning circle for tight residential streets.
- Signage and livery: whether you need your business name visible for site induction.
If you are flat out and just need a ute that will do the job, the fleet is based at Merrylands and delivers. A dual-cab 4x4 diesel with a tray is the usual answer for a Sydney trade.

Towing, trays and toolboxes on a replacement
Towing is where replacement utes most often fall short. A ute with a tow bar is not the same as a ute that can legally tow your trailer. Check the braked towing capacity on the compliance plate, not the brochure. Check the tow ball download, because a loaded box trailer pushes weight onto the rear axle and can put you over GVM before the tray is even full.
Trailer wiring is the other trap. A 7-pin flat plug is common, but if your trailer runs electric brakes you need a controller and a 12-pin plug. If you turn up to a job in Ryde with a trailer that has electric brakes and the replacement has no controller, you are not towing anything that day.
Toolboxes raise a different problem. A full-height canopy toolbox will not fit under the tonneau of a standard tub. If your trade needs a tradie-style alloy tray with under-body boxes, say so at the time of booking, not when the driver hands over the keys at 6am in Alexandria.
Signage is worth thinking about too. Some sites, particularly tier-one builders and government jobs, require vehicles on site to carry the subcontractor's name. A plain white replacement ute can cause a delay at the gate. Ask whether magnetic signs are acceptable, or whether you need to transfer your own.

Start my claimGetting the replacement to the job site
A replacement ute is only useful if it reaches the job, not a depot in the wrong suburb. Delivery is available, and the practical options are delivery to your home, to the repairer, or to the first site of the day. For most tradies, delivery to home before 6am is the one that works, because the ute is loaded the night before and the day starts at the gate.
Think about where the handover happens. A ute delivered to a job site in a residential street in Concord at 7am blocks the street and holds up the crew. A handover at a depot or a car park near the M4 on-ramp is quicker and safer.
Timing matters on the first day. If your ute was towed from the crash scene, you may have tools and materials locked in it. The repairer or the tow yard will usually release them, but you need to ask early and bring ID and the claim number. Do not assume the toolbox will be handed over with the replacement.
For a replacement ute in Sydney, the booking is made online and the car is collected from Merrylands or delivered. Rates, the bond and any fees are shown on the car's page before payment. Bookings are fulfilled by Drive Tribe (drivetribe.com.au), the trading name of Australian Business Holdings Pty Ltd, and this site is part of that group.

Talking to builders and clients about delays
Builders do not care about your insurance claim. They care about the program. The moment you know the ute is off the road, tell the site foreman and the client in the same conversation, with a date you can actually meet. A vague "a few days" is worse than a firm "Thursday".
Be specific about what changes. If you are a tiler and the replacement ute cannot carry a full pallet, say that the first fix will be done by hand and will take an extra half day. If you are an electrician and the ladder has to go on the roof racks instead of inside, say that you will need access to the site compound.
Keep a simple written record of every conversation. A text to the builder confirming the revised start time is enough. If the at-fault insurer later disputes the loss of use claim, that record shows the delay was real and that you mitigated it.
For sole traders, the loss of use claim is often the difference between a flat month and a normal one. There is a separate guide to replacement vehicle claims for sole traders, and one on business vehicle downtime costs that sets out what is recoverable and what is not.
Do not overstate the loss. Insurers and their solicitors read these claims closely, and an inflated figure for a quiet week damages the whole thing. General information only; talk to your accountant or solicitor about your own circumstances.

Keeping the claim moving while you work
The claim does not run itself. Most of the delay in a not-at-fault claim comes from three places: the other driver not lodging a report, the insurer not accepting liability, and the repairer waiting on parts. You can influence all three if you are organised.
- Report the crash to police if anyone was injured, if a vehicle was towed, or if the other driver failed to stop. Get the event number.
- Notify your own insurer, even if you are not claiming on your policy. Most policies require it.
- Get the other driver's name, licence number, registration, insurer and claim reference if they have one.
- Photograph everything: both vehicles, the scene, the road markings, the damage close up and the odometer.
- Keep every receipt and quote connected to the repair and the replacement.
The at-fault insurer may call you directly and offer to arrange a hire car. You are not obliged to accept their choice of vehicle or their choice of repairer. If their offer is a small hatchback and your business runs on a trayback, that is not like-for-like.
If liability is admitted but the hire is being stalled, the escalation path is usually a letter of demand from the credit hire provider's solicitors. Our page on dealing with insurers and the guide to insurer disputes over hire car claims set out how that works.
When the repairer needs the ute longer than quoted
Quoted repair times slip. Parts for a 2022 Ranger or a HiLux can be days away, and prestige or newer models can be longer. If the panel shop calls on a Friday to say the ute will be another two weeks, you have a decision to make about the replacement.
First, get the reason in writing. "Waiting on parts" is not enough for an insurer. Ask which part, from which supplier, and what the expected delivery date is. A repairer who can show a parts order and a delivery estimate gives the claim a much better chance of being paid in full.
Second, tell the credit hire provider the same day. The length of a not-at-fault replacement hire is usually tied to the reasonable repair time, and the provider needs to know the car is staying out. There is a useful explainer on how long you can keep a not-at-fault replacement car in NSW.
Third, consider whether the repair is becoming a write-off. If the assessor decides the ute is uneconomic to repair, the claim shifts from hire to total loss, and that changes the timeline and the paperwork. See repairs and write-offs for the sequence.
If the delay is the insurer's fault rather than the repairer's, keep the replacement. Cutting the hire short to save someone else money just moves the loss back onto you.
Handing the replacement back at the end
The end of the hire is usually straightforward, but a few things catch people out. Clean the ute. Return it with the same fuel level it had when you collected it. Take the tools out before you drive to the return point, because once it is back on the lot you may not get access for a day or two.
Do a walkaround with the person taking the keys. Photograph the tray, the tailgate, the tow bar and the roof. Note any new damage, even a scratch on the tray liner, and get a copy of the condition report. If you added signage, remove it and clean the residue.
Ask for a final invoice or hire period summary. That document is what the credit hire provider uses to recover the cost from the at-fault insurer, and it should match the dates the repairer had the ute. If the dates do not match, query it before you leave.
If the insurer has paid for part of the hire and not all of it, do not assume you owe the balance. Credit hire arrangements are usually structured so the provider pursues the shortfall. Check your agreement and, if you are unsure, talk to your solicitor.
Then get back to work. If you need another ute while a second vehicle is off the road, or you want to add a vehicle to a fleet account, see business and fleet and accident replacement vehicles.
What this means for fleet managers and referrers
If you run a fleet of utes, a single not-at-fault crash can take a vehicle out of service for weeks and leave a crew idle. The fleet version of the problem is a scheduling problem: which job moves, which crew doubles up, and whether the replacement ute can be delivered to the depot before the morning run.
Keep a one-page file on every vehicle: registration, insurer, policy number, who is authorised to accept a replacement, and the usual load and towing setup. When the crash happens, that page is the difference between a replacement on site the next morning and three days of phone calls.
For repairers and brokers, the referral works best when the customer's trade and load are known before the ute is booked. A tiler needs a tray. An electrician needs roof racks and a ladder. A landscaper needs towing. Passing that detail on saves everyone a second handover.
There is a checklist for fleet managers at fleet manager replacement car checklist, and a comparison of funding routes at credit hire versus fleet account. If you refer clients regularly, see partners and referrals.
One last point on liability. A not-at-fault crash does not automatically mean the other insurer will accept the claim quickly. Some do, some take weeks. The replacement ute is what keeps the business running in the meantime.
