If your work ute or SUV is off the road after a not-at-fault crash, the replacement should be chosen by the job it has to do, not by what you would rather drive. A tray, a third row and a tow ball each solve a different problem, and picking the wrong one leaves you hiring again by Wednesday.

This guide compares the two most common business replacement choices against real Sydney work: site runs, crew moves, client pick-ups and towing. It covers payload, seats, access, insurer expectations and when a people mover beats both. It is general information, not legal or financial advice.

Key takeaways

  • Choose the replacement by the tasks the damaged vehicle performed, not by personal preference.
  • A ute wins on tray space, wash-out and towing; an SUV wins on security, comfort and a third row.
  • People movers beat both when six or more people and their luggage must travel together.
  • Towing claims need the loaded trailer weight and the required tow rating in writing.
  • A one-page justification with photos and alternatives considered is what gets a replacement approved.

Start with the job, not the badge

Before you look at a single vehicle, write down what the damaged car actually did in the last month. Not what it was capable of. What it did. If you run a plumbing business out of Blacktown and the ute carried copper, a pipe bender and a ladder every day, a seven-seat SUV is a downgrade no matter how comfortable it is on the M4.

Ask four questions:

  • What has to be carried, and does it fit in a sealed cabin or does it need a tray?
  • How many people travel at once, including apprentices and clients?
  • What gets towed, and how heavy is it loaded?
  • Where does the vehicle park during the day: a customer driveway at Bondi, a loading zone in Parramatta, or a site compound at Eastern Creek?

Those answers point to one body style. A tray ute, a wagon-based SUV and a people mover are not interchangeable, and an insurer or credit hire provider will ask why you need the one you have chosen. The cleanest justification is a written list of the tasks the vehicle performs, backed by photos of the damaged car loaded for work.

If you are still working out whether you have a claim at all, start with not at fault explained, then come back to vehicle choice.

What a ute does that an SUV cannot

A ute gives you a separate cargo space that does not smell, rattle or stain the cabin. For trades, that matters more than anything else on the spec sheet. Sand, wet tarps, cement dust, fuel cans and oily toolboxes all go in the tray, and the cabin stays clean enough to pick up a client afterwards.

The practical advantages:

  • Tray length and load height. Sheet goods, long conduit and ladders travel flat rather than diagonally through a cabin.
  • Wash-out. A tray can be hosed and swept. A carpeted SUV boot cannot.
  • Towing stability. A body-on-frame ute with a live rear axle handles a loaded box trailer or caravan more predictably than a soft-roader.
  • Signage and racking. Magnetic signs, ladder racks and trade canopies are normal on a ute and awkward on an SUV.

The 2026 Toyota HiLux Rogue 4x4 is the obvious like-for-like pick for a double-cab ute claim: 4WD, five seats, a 500 Nm diesel and a tray that takes real work. It is based at Merrylands, which suits jobs across Western Sydney, and delivery is available. Minimum driver age is 25, so check your apprentices are covered before they drive it.

What an SUV does that a ute cannot

An SUV keeps everything inside, out of the weather and out of sight. For a site manager, a sales rep, a building certifier or a business owner who carries samples rather than tools, that is the whole point. Laptops, plans, instruments and stock stay dry on the M1 in a downpour and locked away at a cafe on Military Road.

Where an SUV wins:

  • Security. A sealed, lockable, covered cargo area. Nothing on a tray is truly secure.
  • Passenger comfort and noise. Coil-sprung wagons ride better over the concrete joints on the M2 and the M7.
  • Third row. Many large SUVs seat seven, which a dual-cab ute cannot do.
  • Access. Lower load height for people who are lifting boxes, not engines.
  • Client impression. A clean large SUV reads differently at a North Shore property inspection than a tray with a ladder rack.

The BMW X7 is the benchmark here: seven seats, all-wheel drive, 195 kW and 620 Nm, and a 20 minimum driver age, which makes it easier to put a junior staff member on the policy. It is based at Mascot and delivery is available.

Seven seats, crew and client transport

Crew transport is where most business claims go wrong. A dual-cab ute seats five, and two of those seats are cramped. If your crew is six people plus tools, a ute was never the right vehicle, and a seven-seat SUV or an eight-seat people mover is the honest like-for-like answer.

Think about how the seats are actually used:

  • Daily crew moves. Four to six people between a depot at Girraween and sites at Badgerys Creek. A large SUV with a third row works, but the boot behind row three is small.
  • Client transport. One or two clients at a time, plus a driver. A luxury SUV is the right call, and rear air conditioning matters in February.
  • Mixed days. Crew in the morning, client in the afternoon. This is the hardest pattern to cover with one vehicle, and it is the case for a people mover.

Be realistic about luggage. Seven adults with overnight bags will not fit in a large SUV if the third row is up. If your work involves airport runs to Mascot or crew travel to Newcastle, measure the bags before you commit. A people mover gives you the seats and the boot at the same time.

If your damaged vehicle was a seven-seat SUV and you are offered a five-seat ute as a substitute, that is a like-for-like question worth raising early. See like for like for how that argument is framed.

Towing, payload and the numbers that matter

Towing is the single most common reason a replacement vehicle gets rejected or swapped. If your business tows a trailer, an excavator, a scissor lift or a caravan, the replacement needs a tow bar, the right ball weight and a legal towing capacity that covers the loaded trailer, not the empty one.

Work through this before you book:

  1. Weigh the trailer loaded. A box trailer full of tiles is heavier than most people guess. Use a public weighbridge if you are unsure.
  2. Check the tow rating. The vehicle page states the specification. If it does not list a tow bar, ask before you collect.
  3. Check the ball weight. A vehicle can be within its towing limit and still overload the rear axle.
  4. Check the licence class. Towing a heavy trailer may require a different licence or a log book. That is a question for Transport for NSW, not for a hire company.
  5. Check the driver age. Utes on this fleet are 25 minimum. A 22-year-old apprentice cannot drive them.

Payload is the other trap. A ute's tray capacity is not the same as its payload once you add a canopy, a toolbox, fuel and passengers. Two adults and a full toolbox can eat a surprising amount of a dual-cab's payload before anything goes in the tray.

For a straightforward comparison, the HiLux Rogue and the Silverado both tow and carry, but the Silverado's 624 Nm and larger body suit heavier trailers and longer highway runs. The HiLux is the more practical everyday site vehicle and parks more easily in suburban streets.

If towing capacity is the core of your claim, document it with the trailer's loaded weight and a photo of the damaged vehicle hooked up. More on that below.

When a people mover beats both

A people mover is not a compromise. For some jobs it is simply the correct vehicle, and choosing it makes your claim easier rather than harder.

Choose a people mover when:

  • You regularly move six or more people, and they all need a proper seat with a seatbelt and legroom.
  • You need eight seats and luggage at the same time, such as airport transfers or crew movements with bags.
  • Your work is passenger transport rather than load carrying: shuttle runs, event staff, school or community transport.
  • Sliding doors matter. Loading children or passengers in a tight car park at Chatswood Chase is far easier with a slider than a wide-swinging SUV door.

The Kia Carnival GT-Line seats eight, has a hybrid drivetrain, and a 20 minimum driver age, which makes it easy to add staff. It is based at Mascot with delivery available.

Where a people mover loses: it cannot tow heavy loads, it has no tray, and it will not impress a client the way a large luxury SUV will. If your damaged vehicle was a seven-seat SUV used mainly for client transport, a Carnival is a reasonable like-for-like substitute on seats and space, and a weaker one on presentation. If it was used for towing, it is the wrong vehicle entirely.

Choosing for a mixed fleet

Fleets rarely have one vehicle type, and a single replacement will not cover every job. The practical approach is to rank your vehicles by how hard they are to replace, then replace the hardest one first.

A workable order:

  1. Specialist vehicles first. Anything with a tray, a crane, a refrigerated body or a specific tow rating. These cannot be substituted.
  2. High-use vehicles next. The ute that does 200 kilometres a day around Western Sydney matters more than the spare wagon.
  3. Pool vehicles last. If the fleet has slack, absorb the loss internally before you hire.

Then decide what the replacement actually has to do. If two utes are off the road and one crew needs to move six people, hire one ute and one people mover rather than two utes. That is a defensible, documented decision, and it usually costs less overall than trying to force one vehicle to do two jobs badly.

Keep a simple fleet file: registration, body type, seats, tow rating, daily use and the name of the person who normally drives it. When a crash happens, that file turns a two-hour argument into a five-minute email. Our fleet manager replacement car checklist sets out what to collect, and credit hire vs fleet account explains the two ways to fund it.

How to justify the choice to an insurer

Insurers do not reject replacement vehicles because they are expensive. They reject them because the need is undocumented. Your job is to make the link between the damaged vehicle and the replacement obvious, in writing, before anyone asks.

Build a one-page justification:

  • What the vehicle did. Two or three sentences on daily use, with suburbs and typical distances.
  • Why that requires the body style. Tray, seats, towing or secure cargo. State the specific task.
  • Evidence. Photos of the damaged vehicle loaded for work, a trailer hooked up, a toolbox in the tray, or a full crew inside.
  • Alternatives considered. Say why a smaller or different vehicle would not do the job. This is the part that wins arguments.
  • Duration. The period you need it, tied to the repair timeline.

For towing specifically, provide the loaded trailer weight and the tow rating required. A number beats an adjective every time. If the insurer pushes back, keep it factual and put the request in writing. Dealing with insurers and insurer delays cover the escalation path, and how credit hire works explains who pays and when.

Start the claim properly with not at fault accident replacement, and check availability at accident replacement car Sydney. If you are a sole trader, sole trader replacement vehicle claim covers the extra evidence you will need.

Questions people ask

Can I choose an SUV if my damaged car was a ute?
Only if the SUV genuinely covers the job. If your ute carried tools, a ladder or a trailer, an SUV cannot do that work and the claim will be challenged. If the ute was mainly a comfortable five-seat work vehicle with light loads, a large SUV can be a reasonable substitute. Document what the ute actually carried in the weeks before the crash, with photos, and explain why the SUV meets the same need. Be honest about what you lost.
Is a people mover a reasonable replacement for a seven-seat SUV?
Often yes, if the main job was moving people. A people mover usually seats seven or eight with more usable boot space behind the third row, which is exactly what a seven-seat SUV lacks. It is a weaker match if the SUV towed a trailer or was used for client transport where presentation matters. Match it to the task: passenger movement, yes; towing and prestige client work, no.
How do I justify towing capacity to an insurer?
Give them numbers. State the loaded weight of the trailer, the required tow rating, the ball weight and how often you tow. Add a photo of the damaged vehicle hooked up to the trailer, and a copy of any weighbridge ticket. Then name the replacement vehicle and its tow rating. If the trailer is heavy, note that a lighter vehicle would be unsafe or illegal, and that you are not asking for more than the job requires.
What if my damaged vehicle was a dual-cab ute and my crew is six people?
A dual-cab ute seats five, so it never carried six people legally. If your crew is six, the honest replacement is a seven or eight-seat vehicle, or two vehicles. Explain the real crew size in your justification and let the replacement match it. Claiming a ute you cannot fit your crew into just delays the problem and weakens the rest of your claim.
Do I need a tow bar on the replacement vehicle?
If your business tows, yes. Ask before you book, because not every vehicle on a fleet has a tow bar fitted, and fitting one takes time. Confirm the tow rating and ball weight at the same time, and check the driver age on the vehicle page. Utes on this fleet have a 25 minimum age, so a junior employee may not be able to drive the vehicle you choose.
How long can I keep a business replacement vehicle?
For as long as the repair reasonably takes, or until the claim is settled, depending on how the hire is funded. Keep the repairer and the hire provider talking so the return date is realistic. If the repair is delayed by parts, tell the provider early rather than on the day the vehicle is due back. Delays caused by the insurer or the repairer are usually documented and passed on. This is general information, not legal advice.
