If your fleet car is rear-ended on the M4 between Parramatta and Penrith, you can get a replacement vehicle the same day, and the at-fault insurer usually pays for it. The M4 is Sydney's busiest east-west freight and commuter corridor, and its stop-start traffic produces a steady stream of not-at-fault crashes that leave fleet vehicles undrivable.

This page explains what to do on the shoulder, how to move the drivable cars, how to replace the undrivable ones quickly, and how to keep drivers working while repairs run. It is written for fleet managers, tradies and anyone responsible for getting a business vehicle back on the road after a crash they did not cause.

Key takeaways

  • If you are not at fault in an M4 crash, the at-fault insurer is liable for your loss of use, including a replacement fleet vehicle.
  • You choose the tow destination, not the tow truck driver and not the insurer.
  • Drivable cars should be driven back to the depot, not towed, provided they are safe to move.
  • Like-for-like replacement matters for fleets: a work ute should be replaced with a similar ute, not a small car.
  • A written, specific request to the at-fault insurer is far more effective than a vague phone call.

Why the M4 produces so many not-at-fault crashes

The M4 motorway between Parramatta and Penrith is a funnel. Thousands of cars, utes and vans merge from the M7, the Cumberland Highway and local on-ramps at Prospect, and then hit the stop-start queue that forms westbound from about 3pm and eastbound from about 6am. That queue is where most fleet cars get hit from behind.

Three things make the M4 worse than a typical suburban road:

  • Short merge distances. The on-ramps at Reservoir Road, Wallgrove Road and The Horsley Drive give drivers very little room to match speed, so the car in front brakes hard and the car behind does not react in time.
  • Heavy vehicle traffic. B-doubles and concrete trucks run the corridor all day. A ute that stops suddenly in front of a loaded truck rarely ends well.
  • Sun glare. Eastbound at sunrise and westbound at sunset, the sun sits directly down the carriageway. Drivers misjudge the gap and hit the car ahead.

For a fleet, the pattern is predictable: the vehicle is drivable but the tray, tailgate or rear bumper is pushed in, the driver is shaken, and the at-fault driver's insurer is about to get a call. The legal position is straightforward: if someone else caused the crash, you are entitled to be put back in the position you were in before it, including having a replacement vehicle. That principle comes from the NSW Court of Appeal decision in Arsalan v Rixon, which confirmed that a not-at-fault driver can recover the reasonable cost of a replacement vehicle even if they did not actually hire one.

If you want the legal background in plain English, start with not at fault explained.

What to do on the shoulder before the tow truck arrives

The M4 has narrow shoulders in places, and the section between Wallgrove Road and Mamre Road is particularly tight. Your first job is to get everyone out of the live lanes and behind the barrier, not to exchange details in the middle of the carriageway.

Work through this in order:

  1. Get to safety. Hazards on, pull as far left as you can, and get drivers and passengers behind the concrete barrier or up the embankment. Do not stand between the cars.
  2. Call 000 if anyone is hurt or if a lane is blocked. Police and ambulance will coordinate traffic control.
  3. Photograph everything. Both number plates, the position of the cars, the damage, the road markings and any skid marks. Take a wide shot that shows the location and a close shot of each impact point.
  4. Collect the other driver's details. Name, licence number, phone, insurer and claim reference if they have one. Do not discuss fault or say sorry.
  5. Note the time and location. "M4 eastbound, 400 metres before the Reservoir Road exit, 7:40am" is far more useful than "on the M4".
  6. Call your fleet manager or insurer's accident line and report it the same day.

If the car is drivable and no one is injured, you can often move it to a safer location such as the M4 services at Eastern Creek or a nearby side street before the tow arrives. That keeps the carriageway clear and makes the paperwork easier. Our first 24 hours guide covers the same steps for private drivers.

Getting the drivable cars back to the depot

Not every M4 crash takes a vehicle off the road. A rear-end at 20 km/h might crack a bumper and bend a tow bar without affecting how the car drives. Those vehicles should be driven back to the depot, not towed, because towing adds cost and delay for no benefit.

Before a driver moves a damaged car, check:

  • Lights and indicators still work
  • No fluid leaking under the car
  • Tyres not rubbing on bodywork
  • Boot or tray closes and the load is secure
  • No warning lights on the dash

If any of those fail, treat the car as undrivable and arrange a tow. If they pass, the driver can take it back to the depot, but book it into your repairer within a day or two so the damage is documented before it gets worse.

For a fleet, the bigger issue is the driver. If the damaged car is their work vehicle, they still need to get to the next job. That is where a replacement vehicle comes in, and it can be delivered to the depot, the repairer or the driver's home. If you are booking for a business, the fleet team at Drive Tribe's business and fleet page explains how the account works.

If the damaged car is a ute, see tradie ute replacement after accident for the specific issues around trays, toolboxes and load capacity.

Replacing the undrivable ones the same day

A car that cannot be driven needs a replacement quickly, and for a fleet that usually means the same day. The at-fault insurer is liable for your loss of use, and in NSW that loss is measured by what it would reasonably cost to hire a similar vehicle. You do not have to wait for the insurer to approve a hire before you arrange one.

There are two common ways to fund it:

  • Credit hire. A specialist provider supplies the replacement vehicle on a credit basis and recovers the cost from the at-fault insurer. You pay nothing upfront if the claim is accepted. Read how credit hire works for the detail.
  • Fleet account. Your business hires the vehicle directly and claims the cost back from the at-fault insurer. This suits fleets with an existing account and a good claims process. Compare the two in credit hire vs fleet account.

Like-for-like matters here. A fleet of HiLux work utes should be replaced with a similar 4x4 ute, not a small hatchback, because that is what the business actually needs to keep working. The same goes for a Ranger Wildtrak that tows a trailer or a plug-in hybrid ute used for metro runs.

Delivery is available, so the replacement can be dropped at your depot in Blacktown, a repairer in Penrith or a driver's home in Parramatta. Cars can be booked from a single day, which suits short repairs.

Towing from the M4: who decides where the car goes

Towing is one of the most misunderstood parts of an M4 crash. The rule is simple: you choose the tow destination, not the tow truck driver and not the at-fault insurer.

Under NSW law, the at-fault party is liable for the reasonable cost of towing your vehicle to a place of safety or repair. That means you can direct the tow to your preferred repairer, your depot or a secure holding yard. You are not obliged to send it to a yard nominated by the insurer or by a tow operator who happens to arrive first.

Practical points for fleet managers:

  • Use your own tow provider if you have one. A fleet account with a tow company gives you consistent pricing and a known destination.
  • Get the tow docket. Photograph it and keep the original. The at-fault insurer will want it.
  • Do not sign a blank authority. Some tow operators ask for an open-ended authorisation to store the car. Storage fees can add up fast if the car sits in a yard for weeks.
  • Tell your repairer the car is coming. A five-minute call avoids the car sitting on the street outside a closed workshop.

If the insurer disputes the tow cost, our dealing with insurers page sets out the usual arguments and how to answer them. For write-off situations, see repairs and write-offs.

Keeping drivers moving while repairs run

Repairs on a prestige or performance vehicle in Sydney can take weeks, not days. Parts for a European badge may need to come from interstate or overseas, and a busy repairer in Silverwater or Alexandria may have a queue. During that time, your driver still has a job to do.

Three things keep a fleet moving:

  1. Match the replacement to the job. A ute that carries tools needs a ute, not an SUV. A car that tows needs a tow bar and the right rating. A sales rep covering the M4 corridor needs something comfortable and economical.
  2. Deliver to the driver, not the depot. If the driver lives in Penrith and works out of Eastern Creek, delivering to the depot saves them a trip. Delivery is available across Sydney.
  3. Keep the hire running until the car is back. Loss of use runs until the repair is complete, not until the insurer makes an offer. Do not hand the replacement back early just because the repairer says the car is "nearly ready".

For fleets, downtime has a real cost beyond the hire itself: lost jobs, missed deliveries, subcontractors brought in at short notice. Our business vehicle off-road downtime costs page works through the numbers. If you are a sole trader with one ute, see sole trader replacement vehicle claim.

Telling the at-fault insurer what your fleet actually needs

Insurers handle thousands of claims and tend to default to the cheapest option. Your job is to make the claim specific, documented and hard to argue with. A vague request gets a vague answer.

Send the at-fault insurer a short, factual letter or email that includes:

  • The claim number and the date, time and location of the crash
  • The registration and description of the damaged vehicle
  • What the vehicle is used for (for example, "daily metro deliveries across Western Sydney")
  • The replacement vehicle you need and why it matches
  • The daily hire rate and the expected duration
  • Confirmation that you will mitigate your loss by returning the vehicle as soon as repairs are complete

Keep it factual. Do not inflate the claim and do not threaten. If the insurer pushes back, ask them to put their reasons in writing and respond point by point. Our insurer disputes hire car claim page has template wording.

If your fleet is novated or leased, the finance company may also need to be told. See novated lease car replacement after accident for the steps that apply.

When the crash is on the M4 eastbound at peak hour

An eastbound crash at 7:30am between Prospect and Strathfield is a different problem from a mid-afternoon prang near Penrith. Traffic is heavy, the shoulder is narrow, and tow trucks can take an hour to reach you because they are stuck in the same queue.

What to do differently:

  • Expect a wait. If the cars are drivable and no one is hurt, move them to the M4 services at Eastern Creek or a side street off Reservoir Road and wait there. You will clear the scene faster and the tow will reach you sooner.
  • Use the app or phone to report. Exchange details digitally if the other driver is reluctant to stand on the shoulder.
  • Tell your depot early. A driver stuck on the M4 at 7:30am will miss the first job of the day. A replacement vehicle delivered to the depot by mid-morning keeps the afternoon jobs on track.
  • Watch for secondary crashes. The car that hit you is not the last one that will fail to stop. Stay behind the barrier.

If the crash is on a Friday afternoon before a long weekend, assume repairs will not start until the following week and plan the replacement hire accordingly. For area-specific pages, see replacement by area.

Choosing the right replacement for a fleet ute

Most M4 fleet crashes involve a ute, because utes are what tradies, couriers and service businesses run. Getting the replacement right matters more than getting it cheap.

Three utes that suit different fleet needs:

  • Toyota HiLux Rogue 4x4. A 2.8-litre diesel 4x4 with 500 Nm of torque, five seats and a tray that takes a standard toolbox. A sensible like-for-like replacement for a HiLux work ute. Minimum driver age 25.
  • Ford Ranger Wildtrak 4x4. Similar layout, 500 Nm, five seats, 4WD. A good match when the damaged vehicle is a Ranger or similar dual-cab. Minimum driver age 25.
  • BYD Shark 6 Premium. A plug-in hybrid ute with 321 kW and 650 Nm, five seats and all-wheel drive. Suits metro fleets that want lower fuel use. Minimum driver age 20.

All three are based at Merrylands, which is a short run to the M4, and delivery is available. If you are not sure which one matches your damaged vehicle, see work ute vs SUV replacement comparison.

Setting up a fleet process before the next crash

The fleets that recover fastest from an M4 crash are the ones that decided what to do before it happened. A one-page process saves hours on the day.

Put this in your fleet handbook:

  1. Accident checklist. Safety first, photos, details, report to the fleet manager within the hour.
  2. Preferred repairer. One or two workshops you trust, with a note on their capacity and typical turnaround.
  3. Preferred tow provider. A named company and account number, so no one has to negotiate on the shoulder.
  4. Replacement vehicle contact. A single number for the fleet manager to call, with the vehicle types your business needs.
  5. Claim folder. A shared drive or email folder for photos, tow dockets, hire invoices and repair updates.

If you are a repairer, solicitor or broker who refers clients, our partners and referrals page explains how that works. For a printable checklist, see fleet manager replacement car checklist.

Questions people ask

Can I get a replacement fleet vehicle after an M4 crash?
Yes, if the crash was not your fault. The at-fault insurer is liable for your loss of use, which in NSW is measured by what it would reasonably cost to hire a similar vehicle. You can arrange a replacement through a credit hire provider or your own fleet account and claim the cost back. Delivery is available across Sydney, including to depots in Western Sydney.
Who pays for the tow from the M4?
The at-fault party is liable for the reasonable cost of towing your vehicle to a place of safety or repair. You choose the destination. Keep the tow docket and photograph it, because the at-fault insurer will want it. Do not sign a blank authority that lets a tow operator store the car indefinitely at your expense.
How quickly can replacement vehicles be delivered?
Often the same day, provided the vehicle you need is available and the booking is made early. Delivery can be arranged to a depot, a repairer or a driver's home. For M4 crashes, a morning booking usually means an afternoon delivery. Cars can be booked from a single day, which suits short repairs.
What if the at-fault driver is uninsured or cannot be identified?
If the at-fault driver is uninsured, your options depend on your own policy and whether you have hire car cover. If the driver cannot be identified, you may be able to claim through the Nominal Defendant scheme in NSW. Talk to your insurer or a solicitor about the specific circumstances. Do not assume you have no claim.
Does the replacement vehicle have to be the same make and model?
No, but it should be like-for-like in practical terms. A dual-cab 4x4 ute should be replaced with a similar ute that can carry tools and tow. A prestige sedan should be replaced with a comparable vehicle. The test is what you reasonably need to keep working, not an exact match of badge or trim.
How long can I keep the replacement vehicle?
Until your damaged vehicle is repaired or, if it is a write-off, until the claim is settled and you have had a reasonable time to replace it. Loss of use runs for the period of the loss, not just until the insurer makes an offer. Keep the hire running until the repair is complete, and tell the insurer if the repair is delayed.
