If you have been hit on the Great Western Highway and it was not your fault, you are entitled to stay in a comparable car while yours is repaired, and in most cases the at-fault insurer pays for it. The stretch between Penrith and Katoomba is where this gets tested: long single-lane runs, fast closing speeds, limited run-off, and a repair network that thins out west of Springwood.

This page explains what to do at the roadside, how towing works from the Mountains, where your car will realistically be fixed, how a replacement car reaches Springwood or Katoomba, and what you sign. It is general information, not legal advice.

Key takeaways

  • If the crash was not your fault, you can stay in a like-for-like car while yours is repaired, and the at-fault insurer normally pays for it.
  • The Highway between Penrith and Katoomba produces clear-fault crashes but slow recovery and repair, so allow weeks rather than days.
  • You choose the repairer, and for prestige cars that often means the car travels to Penrith or Sydney rather than staying in the Mountains.
  • Replacement cars can be delivered to Springwood, Katoomba and points between, with handovers arranged at safe, legal locations.
  • Read the credit hire agreement before signing: the rate, the bond and every fee are shown on the car's page before payment.

Why the Highway is unforgiving

The Great Western Highway between Penrith and Katoomba is a 60 kilometre run that changes character three times. Out of Penrith you have dual carriageway and 80 to 90 km/h limits through Glenbrook and Blaxland. From Warrimoo through Valley Heights and Springwood it narrows, with driveways opening straight onto the highway and right-turn movements across traffic. Then Lapstone Hill and the climb to Linden and Woodford give you long grades, tight curves and concrete barriers that leave nowhere to go when someone drifts.

Three crash patterns repeat out here. Rear-end collisions in the 60 km/h roadworks zones around Lapstone and Glenbrook, where traffic stops hard over a crest. Side-swipes on the two-lane sections near Woodford and Hazelbrook when a car crosses the centre line on a curve. And intersection collisions at the Highway and Hawkesbury Road at Springwood, or the Highway and Bathurst Road at Katoomba, where someone turns across a gap that was never there.

Two things follow from this. First, fault is usually clear, which is good for a credit hire claim. Second, recovery and repair are slower than in the city, because everything has to travel up or down the Mountains. If you drive something worth replacing properly, that delay is the part that hurts. The law on this is set out in not at fault explained, and the practical version is below.

What to do immediately after impact

Get off the carriageway if you can. On the Highway, a stationary car in a live lane at dusk is the second accident waiting to happen. Pull onto the shoulder, into a driveway, or into the car park at the Blaxland or Springwood service centres. Put hazards on. If the car will not move, stay in it with your belt on until traffic is stopped, then get behind the barrier.

Then, in this order:

  1. Call Triple Zero if anyone is injured or a lane is blocked. Police attendance also gives you an event number, which insurers ask for.
  2. Photograph everything before anything moves: both cars from four angles, the road position, the lane markings, the skid marks, the other driver's plate and licence, and the general scene including signage.
  3. Collect the other driver's name, address, phone, licence number, registration, and insurer if they know it. Do not argue about fault at the roadside.
  4. Get names and numbers of any witnesses. On the Highway, a following driver is often the best witness you will ever have.
  5. Note the time, the weather, the light and the exact location, down to the nearest cross street or kilometre marker.

Do not accept a cash settlement at the scene, and do not agree to use a particular repairer because someone suggests it. The first day shapes everything, and there is a fuller checklist in the first 24 hours.

Towing from the Mountains

Tow trucks respond from Penrith, Emu Plains, Springwood and Katoomba. On a bad afternoon, when a truck has gone over at Lapstone or a trailer has jack-knifed near Linden, the Highway can be closed for an hour and the first available tow can be 40 minutes away. If your car is driveable but unsafe, say so and get it to the nearest safe car park rather than leaving it on the shoulder overnight.

Two traps catch people out here.

  • The first tow truck on scene is not always the right one. You are entitled to nominate where your car goes. If you drive a prestige or performance car, that means a flatbed with soft straps and a driver who has moved low-clearance cars before, not a hook-and-chain lift.
  • Storage yards west of Penrith fill up and charge by the day. If your car sits in a yard at Katoomba for a week while an insurer decides, that is time and cost you did not need.

Have the car taken to a repairer you have chosen, or to secure storage you have agreed to, and keep the tow docket. If you are not sure where it should go, call before the truck leaves. The same logic applies across the region, and replacement by area covers the local variations.

If you need a replacement car moving the same day, Drive Tribe handles bookings and delivery from its Sydney base, and you can see what is available here: accident replacement car Sydney.

Where your car will realistically be repaired

There are competent repairers in Springwood, Katoomba and Lithgow, and some of them do excellent work on European cars. But for a prestige or performance car, the realistic path is often back down the Mountains. Aluminium-bodied cars, cars needing manufacturer diagnostic equipment, and anything needing a jig or a paint oven usually go to Penrith, St Marys, Blacktown or further into Sydney.

That is not a criticism of local shops. It is about equipment, parts and insurer approval. A Porsche or an AMG that needs structural work will often be routed to a specialist in the Sydney metro area because that is where the measuring systems and the trained technicians are.

What this means for you:

  • Expect a longer assessment phase. A repairer in Penrith may need to collect the car from a Katoomba yard, which adds days before work starts.
  • Parts for European cars are commonly ex-Sydney or ex-Melbourne, and some come from overseas. That is normal and it is the main reason a Mountains repair takes longer than a city one.
  • Ask for the repairer's name and address in writing, and ask who is authorising the work. If the at-fault insurer is paying, they will want to approve the quote.

If the damage is heavy, read repairs and write-offs before you agree to anything, because the difference between a repair and a statutory write-off changes your whole claim.

Getting a replacement car to Springwood or Katoomba

Delivery to the Blue Mountains is straightforward, but it is not instant. A car coming from a Sydney base needs a driver, a clear run up the M4 and the Highway, and a handover point that is safe and legal. The usual handover spots are the Springwood commuter car park, the Katoomba station car park, or a driveway in Glenbrook, Blaxland or Wentworth Falls. Avoid meeting on the Highway shoulder.

Timing matters. If you are collecting at Katoomba, allow for the fact that a driver coming from Sydney in the afternoon peak will lose an hour between Penrith and Lapstone. Morning handovers before 9am are the smoothest. If you work in Parramatta or the city and commute, a handover at Penrith station can be easier than a Mountains delivery, and the car can then live at your place.

What you need at handover: your licence, the claim details, and the paperwork signed. The car will be delivered with a full tank or a stated fuel level, and you should photograph the condition and the odometer before you drive away.

If your own car is a prestige SUV or a performance model, a like-for-like replacement is the point. Two examples that suit this road and this climate:

The insurer conversation when you live out this way

The at-fault insurer will usually call within a day or two. They will be polite, and they will offer to arrange everything: their tow, their repairer, their hire car. You are not obliged to accept any of it, and for a prestige car you should think carefully before you do.

Three things to hold firm on.

  1. You choose the repairer. Insurers can recommend, and they can refuse to pay an unreasonable amount, but they cannot force you to use their shop. If you want your car repaired where you trust the work, say so early.
  2. Like-for-like means like-for-like. A compact SUV is not a replacement for a performance SUV. If the insurer offers something smaller, note it and move on. The principle was tested in the courts and is explained in like for like replacement car meaning NSW.
  3. Keep everything in writing. Emails, not phone calls. If a call matters, follow it up with a summary email the same day.

Insurers sometimes push back on credit hire because they would rather pay a lower daily rate. That is a commercial argument, not a legal one, and the framework is set out in how the at-fault insurer pays for hire. If a dispute starts, insurer disputes hire car claim walks through the process.

How long you might be without your own car

Realistic timelines for a not-at-fault claim on the Highway, from impact to keys back:

StageTypical duration
Tow and storageSame day to 2 days
Assessment and quote3 to 10 days
Parts ordered and received1 to 6 weeks, longer for European parts
Repair in the shop1 to 3 weeks for moderate damage
Total, moderate damage3 to 8 weeks
Total, heavy or structural damage2 to 4 months

The Mountains adds time at both ends. Recovery takes longer, and the car may travel to Penrith or Sydney for repair and back. Parts availability is the single biggest variable, and it is worse for low-volume models.

Credit hire covers the whole period you are reasonably without your car, not a fixed number of days. That is the key difference from the hire car benefit on your own policy, which is usually capped. The comparison is set out in credit hire vs claiming your own insurance, and the full sequence is in credit hire timeline from crash to settlement.

If the car is a genuine write-off, the hire period ends when a fair settlement is paid, not the day the assessor calls it. That is covered in credit hire and write-offs.

What you sign and what it costs

Credit hire is a contract between you and the hire company. You are liable for the hire charges, and the company pursues the at-fault insurer to recover them. That is why the paperwork matters and why you should read it rather than skim it.

What to look for:

  • A clear statement of the daily rate and the total estimated hire period. The rate, the bond and every fee are shown on the car's page before payment.
  • The bond. It equals the excess you choose, and it is refunded at the end of the hire if the car comes back as it went out.
  • Payment method. Paying by card carries a small surcharge; bank transfer and cash on the rental do not.
  • Your obligations: return the car on time, keep it roadworthy, report any new damage, and cooperate with the claim.
  • What happens if the claim is disputed. A well-drafted agreement sets out who does what, and you should understand it before you sign.

There is a full walkthrough in what you sign credit hire paperwork, and the money side is in credit hire costs and who pays what. Cars can be booked from a single day, so you are not locked into a long minimum.

Bookings are fulfilled by Drive Tribe (drivetribe.com.au), and this site is part of that group.

If your car is written off and you need to move quickly, the process is set out here: written off not at fault. For business and fleet vehicles caught in the same crash, see business and fleet and credit hire for business and fleet cars.

If you are a repairer, solicitor or broker

A large share of not-at-fault claims on the Highway come through referrals. A smash repairer in Springwood or Katoomba sees the car before anyone else does. A solicitor handling the property damage claim needs the hire arranged properly so it stands up. A broker wants the client looked after without the claim going sideways.

What a good referral partner provides:

  • Clear like-for-like matching, so the replacement is defensible if the at-fault insurer challenges the rate.
  • Delivery and collection across the Mountains, including Springwood, Blaxland, Wentworth Falls and Katoomba.
  • Paperwork that stands up to scrutiny, with the rate, the bond and the terms set out before the client signs.
  • One point of contact for the life of the claim, not a call centre.

If you refer regularly, the process is set out in partners and referrals. For prestige and performance work specifically, credit hire for prestige and performance cars covers the matching logic, and BMW M and AMG replacement cars deals with the badge-specific questions.

If you are a driver rather than a referrer, the starting point is what to do after a car accident not at fault, and the general framework is at what is credit hire explained. To check availability for a replacement car now, start here: accident replacement vehicles.

Questions people ask

Can a replacement car be delivered to the Blue Mountains?
Yes. Delivery is available across the Mountains, including Glenbrook, Blaxland, Springwood, Wentworth Falls and Katoomba. Handover points are chosen for safety and legality, so a commuter car park or a private driveway is used rather than the Highway shoulder. Allow extra time for a driver coming from Sydney in peak hour, and book a morning handover if you can. You will need your licence and the claim details at handover, and you should photograph the car's condition and odometer before driving away.
Do I have to use the insurer's repairer in Penrith?
No. You are entitled to choose who repairs your car. An insurer can recommend a shop and can decline to pay an unreasonable amount, but it cannot force you to use its network. If you drive a prestige or performance car, check that your chosen repairer has the equipment and training for your model. If the insurer pressures you, ask for the request in writing and keep a record. The choice is yours, and it is worth exercising on anything European or low-volume.
What if my car is a write-off?
A write-off changes the shape of the claim but not the principle. You are still entitled to a like-for-like replacement while the claim is resolved, and the hire period generally runs until a fair settlement is paid rather than the day the assessor calls it. If the car is a statutory write-off it cannot be re-registered, which affects salvage and any payout. Get the assessment in writing, do not accept the first figure without checking comparable vehicles, and take advice if the offer looks low.
How long can I keep the replacement car?
For as long as you are reasonably without your own car because of the crash. That covers the assessment, parts wait and repair time, and it is not capped at a fixed number of days the way a policy hire car benefit usually is. Realistic totals on the Highway run from three to eight weeks for moderate damage and longer for structural work. Cars can be booked from a single day, so there is no long minimum if your repair finishes early.
Who pays for the replacement car?
In a not-at-fault claim, the at-fault insurer is pursued for the hire charges. You sign an agreement with the hire company, which then recovers the cost from the other side. You are liable on the contract, which is why the paperwork matters. The rate, the bond and every fee are shown on the car's page before payment. Paying by card carries a small surcharge, while bank transfer and cash on the rental do not. The bond equals the excess you choose.
What if the other driver is uninsured or won't cooperate?
It complicates recovery but does not remove your right to a replacement car. The claim can still proceed against the at-fault driver directly, and in some cases through your own insurer with recovery pursued afterwards. Keep every document: photos, witness details, the event number if police attended, and any correspondence. If the other driver denies fault, the physical evidence from the Highway scene usually matters more than anything said at the roadside. Take advice early if the dispute looks serious.
