If your M3 Competition or C63 S is off the road after a crash that was not your fault, you are entitled to a replacement that matches what you actually drive, not a base model with a CVT. Like-for-like means the same tier of car, the same body style and the same practical capability you had before the collision.

This guide covers the M3 Competition generations, xDrive versus rear-wheel drive, the C63 S question, what insurers push back on, and how delivery works across Parramatta, Merrylands and the Inner West. It is written for people whose daily is a 400 horsepower sedan and who want the replacement to feel like one.

Key takeaways

  • Like-for-like for a performance sedan means matching tier, body style and drivetrain, not just providing any car.
  • An F80 M3 Competition is best replaced by an F80, a G80 by a G80, and an xDrive by an xDrive.
  • A C63 S is generally accepted as a fair replacement for an M3 Competition, and vice versa, because both are 375 kW rear-drive performance sedans.
  • Insurers push back hardest on daily rate and hire period, so keep repair updates and handback records.
  • Delivery is available across Parramatta, Merrylands and the Inner West, often to your repairer's forecourt.

Why a performance sedan is not swapped for a base model

The law in New South Wales on this point is settled. In Arsalan v Rixon, the Court of Appeal confirmed that a person who has lost the use of their car through another driver's negligence can recover the reasonable cost of a replacement, and that reasonableness is measured against the car they actually had. Not the cheapest thing that moves.

For a BMW M3 or a Mercedes-AMG C63 S, that distinction matters more than it does for a Corolla. A base 3 Series or a C200 is a different proposition: different power, different drivetrain, different brakes, different seats, different presence on the road. If you use your M3 to tow nothing but yourself to client meetings in North Sydney and school pick-up in Strathfield, the replacement still needs to do that with the same level of comfort and capability.

Insurers sometimes argue that any sedan is equivalent. That argument tends to collapse when you point out the specifics: your car had 375 kW, a limited-slip differential, adaptive dampers and a warranty that depends on how it is treated. A base model does not replicate any of that.

What like-for-like does not mean is a free upgrade. If your car is a 2016 F80 M3, you are not automatically entitled to a 2024 G80 xDrive. The replacement should sit in the same tier and generation ballpark. Our like-for-like explainer goes deeper on how that is assessed.

The M3 Competition generations and which one matches yours

BMW has built three distinct M3 Competition generations that matter for replacement purposes in Sydney, and they are not interchangeable when an insurer or a credit hire company is assessing equivalence.

GenerationYearsPowerDrive0-100 km/h
F802016331 kWRear-wheel drive4.0s
G802021375 kWRear-wheel drive3.9s
G80 xDrive2024390 kWAll-wheel drive3.5s

If your car is an F80, a 2016 M3 Competition is the closest match. It has the S55 twin-turbo straight-six, the same rear-drive layout and the same dual-clutch or manual feel depending on spec. Handing someone a G80 when their F80 is in the shop is not wrong, but it is a different car to live with.

The G80 brought the S58 engine and a much stiffer chassis. If your 2021 or 2022 G80 is being repaired, a 2021 G80 Competition is the natural replacement. The 2024 xDrive car is a step above in tier and drivetrain, and it is the right match for a current xDrive owner.

Where this gets practical is Parramatta Road. If you commute from Parramatta into the city each morning, the difference between an F80 and a G80 xDrive in traffic is mostly the gearbox and the ride. Both are fine. But if your car is an xDrive and you get a rear-drive car in July, you will notice it on the M4 on-ramp at Rydalmere in the wet.

Rear-wheel drive versus xDrive and matching the drivetrain

Drivetrain is the argument that catches people out. If your M3 Competition is xDrive, a rear-wheel drive replacement is not equivalent in the conditions Sydney actually delivers: greasy mornings on the M2 at Pennant Hills, standing water on the M4 at Eastern Creek, and the steep, cambered streets around Balmain and Birchgrove after rain.

xDrive also changes how the car puts power down. A 390 kW xDrive car will launch harder and feel more secure in the wet than a 375 kW rear-drive car, even though the power figures are close. For a replacement to be genuinely like-for-like, the driven wheels should match.

There is a second layer here: the way the car is used. If you regularly drive to the Snowy Mountains in winter, an xDrive replacement matters. If your M3 is a weekend car that lives in a garage in Mosman and comes out for the Old Pacific Highway run to Cowan, rear-wheel drive is what you had and what you want back.

Tell the replacement provider which one you have. It is a two-second question and it prevents a week of irritation. The same logic applies to the C63 S, which is rear-wheel drive only in the 2017 generation, so there is no all-wheel drive equivalent to chase.

If you are booking through the fleet, the not-at-fault replacement page sets out how the vehicle is chosen and what the rate, bond and fees look like before you pay. Bookings are fulfilled by Drive Tribe (drivetribe.com.au), and this site is part of that group.

The C63 S and the AMG question: badge, power and exhaust note

The 2017 C63 S runs a 4.0-litre twin-turbo V8, 375 kW and 700 Nm, rear-wheel drive, and it sounds like nothing else in the class. If that is your car, a replacement needs to be in the same tier. A C200 or a C300 is not it.

Can a C63 S stand in for an M3 Competition? In practice, yes, if the tier and body match. Both are 375 kW rear-drive performance sedans with five seats and a boot that takes a set of golf clubs. The M3 has a straight-six and the C63 S has a V8, so the character differs, but the practical capability is equivalent. Insurers and credit hire assessors generally accept that as like-for-like.

What they sometimes resist is the badge. If your car is an AMG, they may offer a standard Mercedes-Benz. That is the point to push back. The AMG badge is not cosmetic: it brings a different engine, different suspension, different brakes and a different driving experience. Our AMG replacement guide covers how to frame that conversation.

The exhaust note is not a legal category, but it is part of why people buy the car. If you drive the C63 S for the sound on a Sunday morning through the Royal National Park, a silent four-cylinder replacement is a real loss of amenity. That is a legitimate point to raise, and it is one of the reasons the law recognises loss of amenity as well as physical inconvenience.

What insurers argue about performance car hire rates

The most common pushback is not about whether you get a replacement. It is about how much the replacement costs per day and whether that rate is reasonable. Performance and exotic cars cost more to hire than a Camry, and insurers know it.

Their arguments tend to fall into four buckets:

  • That a cheaper car would have done the same job.
  • That the hire period was longer than the repair required.
  • That the rate itself is above market.
  • That you should have mitigated your loss by hiring something cheaper and claiming the difference.

The answer to the first and fourth is the same: like-for-like is measured against your car, not against the cheapest available transport. The answer to the second is documentation. Keep the repairer's updates, the parts delays, the booking dates and the handback date. If the repair took three weeks because a bumper was on backorder from Germany, that is not your fault and it is recoverable.

On rate, the question is what a comparable car actually costs to hire in Sydney on the open market. A 2024 M3 Competition xDrive is not a Corolla, and no amount of argument changes the replacement cost of a 390 kW all-wheel drive sedan. Our dealing with insurers page has the language that tends to move things along, and how credit hire works explains who carries the cost while the claim is running.

If the insurer delays beyond what is reasonable, there is a process for that too. Insurer delays covers the escalation path.

Tyre, fuel and running costs while you have the replacement

A performance car uses more fuel and eats tyres faster than a base model, and that is true of the replacement too. You are not reimbursed for fuel, and you should not expect to be. Fill it with 98 octane, as you would your own car.

Tyres are the one to watch. If you have the car for three weeks and do your usual 600 km a week, you will not wear out a set of Michelin Pilot Sports, but you will notice the cost if you are used to a smaller car. Check the pressures before a long drive. The M3 and C63 S both run staggered setups, so front and rear pressures differ.

Other practical points:

  • The bond equals the excess you choose, and it is refunded after the car comes back in the same condition.
  • Paying by card carries a small surcharge; bank transfer and cash on the rental do not.
  • The minimum driver age is 25 on the M3 Competition cars and 20 on the C63 S, so a younger driver may be able to be added to the C63 S but not the M3.
  • All cars are self-drive; the 2024 M3 Competition xDrive can also be chauffeured if you would rather not drive.
  • Cars can be booked from a single day, which suits a short repair.

Do not put E10 in any of them. Do not take it through an automatic car wash with brushes. Treat it as you would your own car, because the handback inspection will look at exactly that.

Delivery to Parramatta, Merrylands and the Inner West

The M3 Competition cars and the C63 S are based in Parramatta, which makes delivery straightforward across Western Sydney and the Inner West. Typical delivery windows are weekday mornings between 8am and 11am, and Saturday mornings by arrangement.

Where people take delivery:

  • Parramatta CBD, including the streets around Church Street and the Parramatta Square precinct.
  • Merrylands, Guildford and Granville, often to a home driveway or a workplace car park.
  • The Inner West: Strathfield, Burwood, Ashfield, Leichhardt, Newtown and Marrickville.
  • Repairer forecourts, if you would rather the replacement meet you where your car is being fixed.

If your car was towed to a smash repairer in Silverwater or Rydalmere, delivery to the repairer is often the simplest option. You drop the keys, sign the paperwork, and drive away in the replacement without needing a lift home.

For the Inner West, the practical issue is parking. An M3 Competition is 4.8 metres long and the streets around Enmore and Erskineville are tight. If you have off-street parking, use it. If not, tell the delivery driver where you want the car left and check the mirrors before you pull out.

Delivery is available on all four cars in this article. If you are in the Hills, the Northern Beaches or the Shire, ask about the window before you book, because a delivery to Palm Beach at 5pm on a Friday is a different job to a delivery to Parramatta at 9am on a Tuesday.

Handing the car back when your repair is finished

The handback is where small things become arguments. Do it properly and the bond comes back without a fight.

  1. Wash the car, or at least remove the road grime. A dirty car hides nothing and makes the inspection slower.
  2. Check the fuel level. It does not need to be full, but it should be at the level it was delivered at.
  3. Remove your belongings, including the garage remote, the Opal card and anything in the boot under the floor.
  4. Note any new damage, however small. A kerbed wheel on a performance car is expensive, and it is better to raise it than to have it found later.
  5. Confirm the handback date in writing with the provider and, if relevant, the insurer.

If the repair is finished early, hand the car back early. The hire period should match the repair period, and a shorter period is easier to defend if the insurer queries it.

If the repair runs long, tell the provider before the booked return date. Extensions are usually straightforward, but an unreturned car on the day it was due is a problem.

One more thing: keep the handback photos. A timestamped photo of the odometer, the fuel gauge and each corner of the car takes two minutes and settles most disputes before they start. Our repairs and write-offs page covers what happens if the repair turns into a write-off instead.

When you are ready, check availability for an accident replacement car in Sydney and have your claim details handy.

The first 24 hours after a not-at-fault crash in a performance car

What you do in the first day shapes the whole claim. For a performance car, a few things matter more than they would for a base model.

  • Photograph everything: both cars, the road position, the intersection, the damage close up, and the other driver's licence and rego.
  • Get the other driver's insurer and claim number if they admit fault. If they do not, do not argue at the scene.
  • Do not let a tow truck take your car to a repairer you have not chosen. You have the right to nominate where it goes.
  • Call your own insurer to notify, even if you are not claiming through them.
  • Note the time, the weather and the traffic. If it was 7.45am on Victoria Road at Rozelle, say so.

Then arrange the replacement. The sooner it is on the road, the sooner the loss of use is mitigated, and the easier the claim is to document.

Our first 24 hours checklist is the version to keep in the glovebox, and evidence to collect at the scene covers the specifics. If you are a fleet manager or a repairer, partners and referrals explains how referrals work.

Questions people ask

Will I get another M3 if my M3 is repaired?
You should get a car in the same tier and generation. If your car is a 2016 F80 M3 Competition, the closest match is another F80. If it is a 2021 G80, you should get a G80, and if it is an xDrive, the replacement should be all-wheel drive. A base 3 Series is not a like-for-like replacement for an M3, and you can say so. The exact car depends on what is available on the day, so book early and be specific about your generation and drivetrain.
Is a C63 S a fair replacement for an M3?
In most cases, yes. Both are 375 kW rear-wheel drive performance sedans with five seats, a similar footprint and comparable running costs. The M3 has a straight-six and the C63 S has a V8, so they feel different, but the practical capability is equivalent. Insurers and credit hire assessors generally accept the swap. If your car is an M3 Competition xDrive, a rear-drive C63 S is a step down in wet-weather traction, so push for an xDrive replacement instead.
Can I take a performance replacement car on a track day?
No. Replacement cars are provided for ordinary use while your car is being repaired, and track use is excluded. That means no Sydney Motorsport Park, no Wakefield Park, no drag strip and no timed runs. It also means no driver training days that involve laps at speed. If you damage the car on a track, you are responsible for the repair and the bond. Keep it on the road, use it as you would your own car for commuting and daily driving, and leave the track until your own car is back.
How long can I keep the replacement car?
The replacement should run for the reasonable repair period, which for a prestige car in Sydney is often two to four weeks depending on parts availability. German performance parts can take longer if they come from overseas. Keep the repairer's updates and the booking dates. If the repair runs long, tell the provider before the return date and extend. If the repair finishes early, hand the car back early. The hire period should match the repair period, and a shorter period is easier to defend.
What do I need to bring when I collect the replacement?
Bring your driver licence, a credit or debit card in your name, and your claim details including the other driver's insurer and claim number if you have them. The minimum driver age is 25 on the M3 Competition cars and 20 on the C63 S. The rate, bond and any fees are shown on the car's page before you pay. Paying by card carries a small surcharge, while bank transfer and cash on the rental do not. The bond equals the excess you choose.
Can I add a second driver to a performance replacement car?
Yes, provided the second driver meets the minimum age for that car, which is 25 on the M3 Competition cars and 20 on the C63 S. They will need to present a valid licence and be added to the rental agreement before they drive. Do not let anyone drive who is not on the agreement, because that voids the cover and leaves you exposed if anything happens. If you are unsure, ask when you book and have their licence details ready.
