Illawarra Crash? Getting a Like-for-Like Car

If you have been hit on the Princes Highway or anywhere from Helensburgh to Kiama and it was not your fault, you are entitled to a replacement vehicle that matches what you were driving. That means a like-for-like car, not a compact hatch, and the at-fault insurer is the one who should be paying for it.

This page explains how it works in the Illawarra: what to do at the scene, where to tow, how delivery to Wollongong, Dapto, Shellharbour or Kiama works, and how long you can keep the replacement while your car is being repaired.

Key takeaways

  • If the crash was not your fault, the at-fault insurer is expected to cover a like-for-like replacement car while yours is repaired.
  • Delivery is available across the Illawarra, including Wollongong, Dapto, Shellharbour and Kiama, often same day or next morning.
  • You choose your own tow and repairer; do not sign anything at the scene or accept cash.
  • The replacement stays with you until your car is repaired or the write-off is settled, so keep the repairer's timeline in writing.
  • Credit hire means you do not pay upfront; the hire company recovers the cost from the at-fault insurer.

Illawarra crash hotspots

The Illawarra is a corridor. Most of us live along the Princes Highway and the South Coast Line, and most crashes happen where that corridor gets squeezed or interrupted.

The worst spots are predictable. The Mount Ousley descent and the Picton Road merge at the bottom of the escarpment catch people out in the wet. The Princes Highway through Fairy Meadow and Corrimal is stop-start with driveways and buses. The M1 interchange at Albion Park Rail is a merge point where southbound traffic meets the highway. In Wollongong itself, the Crown Street mall approaches and the Gwynneville roundabout at the university turnoff are rear-end factories, especially between 8am and 9am and again from 4.30pm.

Further south, the Kiama bends and the Jamberoo Mountain Road turnoff see their share of run-offs, and the Shellharbour Road and Lake Entrance Road intersections at Warrawong and Shellharbour are heavy with tradie utes and delivery vans during the day.

What these spots have in common is that they are not at-fault crashes for the person in front. They are rear-enders, side-swipes and intersection collisions caused by someone else. If that is you, the law in NSW is on your side, and the replacement vehicle is part of the claim.

If you want the legal background in plain English, our not at fault explained page walks through it. The short version: you should not be out of pocket for a crash you did not cause.

What to do at the scene on the Princes Highway

A crash on the Princes Highway is different from a crash in a car park. Traffic is moving, the tow trucks are circling, and everyone wants you to make a decision in the first ten minutes. Do not.

Get off the road if you can. Put your hazard lights on and get behind the barrier. Call 000 if anyone is hurt. If the cars are drivable and no one is injured, you can move them to a side street or a nearby car park, but take photos first: all four corners of both cars, the number plates, the road position, the traffic lights if they are in shot, and the other driver's licence and rego papers.

Then do the thing most people forget. Write down the other driver's name, address, phone number, insurer if they know it, and the make and model of their car. If they will not give you their insurer, that is fine, but get their details. If a witness stops, get their number too.

Do not argue about fault at the scene. Do not accept cash. Do not sign anything a tow truck driver hands you. You are allowed to choose your own tow and your own repairer, and you are allowed to arrange your own replacement car.

Our first 24 hours checklist covers the exact order to do things in, including what to say when the insurer calls.

Towing and repairer options in the Illawarra

The Illawarra has good repairers, but the good ones are booked. Prestige and performance repairs take longer than a Corolla bumper because parts come from overseas and the panel shop needs the right equipment and the right painter.

You have three realistic options.

  1. A local prestige-capable shop. There are shops around Wollongong, Unanderra and Albion Park Rail that handle European marques. Ask whether they are insurer-approved or independent, and ask how long the wait is for a booking.
  2. A Sydney specialist. Some owners prefer to send the car to a Sydney shop that works on their brand every day. That is allowed. It just means the car is away longer, which is exactly why the replacement vehicle matters.
  3. Your insurer's nominated shop. If you are claiming on your own policy, they may steer you to their network. You are not obliged to use it, but if you do, the repair is usually guaranteed by the insurer.

Whichever you choose, get the repairer to give you a written estimate and a realistic completion date. That date drives how long you keep the replacement car.

If the car is a write-off, the process changes. Read our repairs and write-offs page before you accept any settlement figure.

Delivery to Wollongong, Dapto, Shellharbour or Kiama

You do not need to come to Sydney to pick up a replacement car. Delivery is available across the Illawarra, and it is usually the same day or the next morning if you call early.

We deliver to homes, workplaces, repairers and train stations. If your car is at a panel shop in Unanderra, we can meet you there. If you are working on the Wollongong foreshore or at the Port Kembla industrial estate, we can drop the car to you. If you are in Dapto, Shellharbour, Warilla or Kiama, we cover that too.

What you need ready:

  • Your driver licence.
  • A credit or debit card in your name for the bond and the security hold.
  • The other driver's details and, if you have it, their insurer's claim number.
  • Your own insurer's details if you have lodged a claim with them.

The rate, the bond and any fees are shown on the car's page before you pay. Paying by card carries a small surcharge; bank transfer and cash on the rental do not. The bond equals the excess you choose. You can book from a single day.

Bookings are fulfilled by Drive Tribe (drivetribe.com.au), the trading name of Australian Business Holdings Pty Ltd, and this site is part of that group. You can see the Sydney accident replacement fleet and check availability at accident replacement car Sydney.

If you are not sure what car suits your situation, our replacement by car type page breaks it down.

Like-for-like for a performance car or SUV

Like-for-like does not mean "a car". It means a car of similar size, prestige and capability to the one you were driving. If your Macan is in the shop, a compact SUV is not like-for-like. If your Taycan is off the road, a petrol sedan is not like-for-like.

In the Illawarra, that matters more than people think. A lot of residents drive performance SUVs and European sedans because the commute to Sydney is long and the roads are fun when they are empty. Losing that car for three weeks is a real cost, and the at-fault insurer is expected to cover a reasonable equivalent.

Here is what we can put you in while yours is repaired.

How a not-at-fault replacement runs
AccidentClaim lodgedCar deliveredYour car repairedHire recovered from the at-fault insurer

If the at-fault driver is from Sydney

This happens constantly on the Princes Highway and the M1. A Sydney driver comes down for the weekend, misjudges the Mount Ousley descent, and rear-ends a local. Their insurer is in Sydney, their repairer is in Sydney, and suddenly you are dealing with a claims process that assumes you are in Sydney too.

You are not. You are in Thirroul or Figtree or Albion Park, and you should not have to drive to Sydney to sort out a replacement car.

The at-fault driver's insurer is still the one who owes you the replacement. Their location does not change that. What changes is the logistics: the assessor may want to inspect your car in the Illawarra, the repairer may need to order parts, and the hire car needs to be delivered to you rather than collected from a Sydney depot.

If the insurer pushes back, or offers you a smaller car than yours, do not just accept it. Our dealing with insurers page explains the usual arguments and how to answer them. If it escalates, insurer disputes covers the next step.

For fleet managers dealing with this across multiple drivers, the fleet manager checklist is the place to start.

How long the replacement stays with you

The replacement car stays with you until your car is repaired and back in your hands, or until the claim is settled if it is a write-off. That is the principle. In practice, the length depends on the repair timeline and on how quickly the insurer authorises the work.

Typical Illawarra timelines:

SituationLikely duration
Bumper and panel repair, parts in stock1 to 2 weeks
European panel and paint, parts from overseas3 to 6 weeks
Structural or airbag damage6 to 12 weeks
Write-off and settlementUntil settlement is agreed

These are estimates, not promises. The repairer's written estimate is the number that matters.

If the insurer tries to cut the hire off before the repair is finished, that is a dispute, and it is usually resolvable. The key is to keep the repairer's updates in writing and pass them on.

For a deeper look at how long you can keep a not-at-fault replacement car in NSW, see this guide.

What the at-fault insurer owes you

In NSW, if another driver caused the crash, their insurer is expected to put you back in the position you were in before it happened. That includes the cost of a replacement vehicle while yours is being repaired, provided the replacement is reasonable and the cost is recoverable.

What that means in practice:

  • You are entitled to a like-for-like vehicle, not the cheapest thing on the lot.
  • The hire period should match the reasonable repair time.
  • The insurer can question the rate, but they cannot simply refuse to pay because they would have chosen a cheaper car.
  • You should not have to fund the replacement yourself and hope to be reimbursed.

This is where credit hire comes in. A credit hire arrangement means the replacement vehicle is provided to you on credit, and the hire company recovers the cost from the at-fault insurer. You do not pay upfront. Our how credit hire works page explains the mechanics, and not at fault accident replacement covers the broader process.

If you run a business, the calculation is different. A ute off the road is lost income, not just inconvenience. See business vehicle off-road downtime costs and tradie ute replacement.

Nothing here is legal advice. If your claim is complex, talk to your solicitor.

Fleet, business and referral partners in the Illawarra

The Illawarra has a lot of small fleets: trades with three or four utes, real estate agencies with a pool of SUVs, clinics with a practice manager's car. When one of those is hit, the downtime cost is immediate.

For fleet managers, the priority is getting the driver mobile again without tying up the business's cash. A fleet account or credit hire arrangement can do that. Our credit hire vs fleet account page compares the two, and accident replacement vehicle for business covers the business-specific issues.

If you are a smash repairer, solicitor or broker in Wollongong, Dapto, Shellharbour or Kiama and you regularly deal with not-at-fault clients, we work with referral partners. The partners and referrals page explains how that works, and contact is the fastest way to start a conversation.

For sole traders, sole trader replacement vehicle claim covers the specific evidence you need to keep. For novated leases, see novated lease car replacement.

Questions people ask

Do you deliver replacement cars to the Illawarra?
Yes. We deliver to homes, workplaces, repairers and train stations from Helensburgh down to Kiama, including Wollongong, Dapto, Shellharbour, Warilla and Albion Park. Delivery is usually same day or next morning if you call early. You will need your driver licence and a card in your name for the bond. The rate, bond and any fees are shown on the car's page before you pay.
What if my car is repaired in Wollongong?
That is fine. We can deliver the replacement to the repairer, to your home or to your workplace, and collect it when the repair is done. If the repairer is in Unanderra, Fairy Meadow or Albion Park Rail, we cover those too. Just give us the repairer's details and the estimated completion date when you book.
How long can I keep the replacement car?
You keep it until your car is repaired and back with you, or until a write-off settlement is agreed. The repairer's written estimate is the key document. If the insurer tries to cut the hire short before the repair is finished, that is a dispute and it is usually resolvable. Keep all repair updates in writing.
What if the at-fault driver is from Sydney?
It does not change your entitlement. The at-fault insurer still owes you a like-for-like replacement. What changes is the logistics: the assessor may inspect in the Illawarra and the hire car needs delivering to you. If the insurer offers a smaller car than yours, push back and keep the correspondence.
Do I have to pay for the replacement car upfront?
No. Under a credit hire arrangement, the replacement is provided on credit and the hire company recovers the cost from the at-fault insurer. You do not pay the hire upfront. You will still need a card for the bond, which equals the excess you choose. Paying by card carries a small surcharge; bank transfer and cash on the rental do not.
What if my car is a write-off?
If the car is written off, the replacement stays with you until settlement is agreed. Do not accept the first settlement figure without checking it against comparable cars. Our repairs and write-offs page covers the process. If the figure seems low, talk to your solicitor before signing anything.
