School holiday crashes: credit hire for family cars

If your family car is hit in the school holidays and the crash was not your fault, you can usually keep driving a comparable car at the at-fault insurer's cost through credit hire. A small hatchback is not a like-for-like replacement for a seven seat SUV when you have three kids, a pram and a week of sport ahead.

The practical questions are seat count, child seat fittings, delivery timing and what counts as reasonable use. Here is how it works in New South Wales, from the first call to the day you hand the car back.

Key takeaways

  • Like-for-like is about function, so a seven seat family car should be replaced by a car that genuinely carries seven people.
  • Arsalan v Rixon in the High Court confirms a not-at-fault driver can recover the reasonable cost of a replacement vehicle, including loss of amenity.
  • You can fit your own child seats to a hire car, but check anchor points and third row tether positions before you accept it.
  • Book the replacement as soon as the claim is lodged, and ask for morning delivery so you have the car before school pick-up.
  • Keep a file of repairer updates, photographs and the hire agreement, because reasonableness is the argument insurers actually run.

Why seat count matters in a like-for-like claim

Like-for-like is not about matching the badge. It is about restoring the use you actually had. If your car carried seven people and the replacement carries five, the hire does not restore your loss of use, and the shortfall is yours to absorb.

The legal foundation in New South Wales is the High Court decision in Arsalan v Rixon, which confirmed that a not-at-fault driver can recover the reasonable cost of a replacement vehicle, including loss of amenity where the substitute is inferior. A five seat hatch in place of a seven seat SUV is exactly the sort of inferior substitute that decision covers.

Seat count is the easy part. The harder parts are the things a family notices by day three:

  • Boot space for a pram, a cricket bag and a week of groceries
  • Whether the third row folds flat enough to take a bike
  • Roof or tow capacity if you tow a trailer or carry a kayak
  • Whether the car fits your garage, your driveway or the school pick-up lane
  • Child seat anchor points and how many you need at once

Insurers rarely argue that a seven seat car should be replaced by a five seat car when the paperwork is clear. They argue about the tier of the replacement. That is where photographs of your own car, loaded, do more than any written description. A photo of the third row in use on a Saturday morning is worth more than a paragraph about family logistics.

If you want the general framework first, read like-for-like and not at fault explained before you accept anything.

School run, sport and holiday trips

Term three and term four are the worst weeks of the year for family car availability. Between the June-July break and the December-January break, Sydney's prestige and seven seat fleet gets tight, because everyone who can take a holiday does.

Think about what a normal week looks like. School drop-off at 8:15 in Mosman or Randwick, then a run down to Moore Park for netball, then Saturday morning soccer at Centennial Park, then a Sunday trip to the Central Coast or the Southern Highlands with grandparents in the back. That is not one journey. That is a week of journeys, and a five seat loan car falls apart on the first Saturday.

School holiday crashes also cluster in specific places. The car park at Westfield Bondi Junction on a rainy Saturday. The Pacific Highway at Pymble at 5:30pm on a Friday. Military Road at Neutral Bay when the beaches traffic backs up. The M1 at Berowra on the first Sunday of the holidays, when everyone leaves at once.

If your car is off the road for three weeks in July, you are not just replacing transport. You are replacing the thing that makes the household work. That is the loss the claim is meant to cover.

When you know you need a genuine seven or eight seat replacement, the fleet to look at is here: accident replacement vehicles.

Child seats and fitting them to a replacement

You can fit your own child seats to a hire car. Nothing in the hire agreement stops you, provided you fit them correctly and remove them before the car goes back.

The practical issues are anchor points and space. Most modern SUVs and people movers have ISOFIX points in the second row and top tether anchors behind the second row. The third row is where it gets fiddly. Some seven seat SUVs have tether points in the third row, some do not, and some have them in a position that makes a rear-facing seat awkward.

Before you accept a replacement, check:

  1. How many child seats you need at once, and in which rows
  2. Whether your seats are ISOFIX, seatbelt-mounted or both
  3. Whether the third row has top tether anchors if a child seat goes there
  4. Whether an adult can still sit beside the seats on a long drive
  5. Whether the boot still takes the pram with all three rows up

If you are unsure, ask for the car's manual or check the anchor points in person at collection. Fitting a seat incorrectly is a safety issue and, in New South Wales, a legal one. Take the five minutes.

If your own seats were damaged in the crash, keep the receipts and photographs. Replacement child seats are a recoverable item in many not-at-fault claims, and an insurer will ask for proof.

What to do when your exact model is unavailable

You are entitled to a like-for-like replacement, not to your exact car. If your X7 or Q7 is in the shop and no identical model is free, the question becomes what is genuinely comparable.

The test is function, not badge. A seven seat diesel SUV with decent torque and a proper boot is comparable to another seven seat diesel SUV with the same layout. A five seat sedan is not, no matter how nice it is.

Each is a genuine multi-row car with delivery available. The X7 and the GV80 are seven seat SUVs; the Carnival is an eight seat people mover, which is often the better answer when you have three child seats and a pram, because the sliding doors and flat floor make the school run materially easier.

Note the age limits. The X7 and Carnival can be driven from 20; the GV80 requires a minimum driver age of 30. If a younger driver in the household needs to use the car, say so at booking, because it changes what you can be given.

If nothing comparable is available on the day, ask what is coming back and when. A two day wait for the right car is usually better than three weeks in the wrong one, and the at-fault insurer is on the hook for the period your car is genuinely off the road.

Delivery around holiday schedules

Delivery is where holiday hires either work or fall apart. You do not want to be standing in a queue at a depot in Alexandria at 4pm on the Friday before the school break with three kids in the back of a taxi.

Ask for delivery to your home or to the repairer. Most Sydney prestige hires can be delivered across the metro area, including the Northern Beaches, the Inner West, the Shire and the Hills. Be specific about the address and the access. A tight underground car park in Potts Point or a steep driveway in Seaforth changes what can be delivered and how.

Timing tips that save a day:

  • Book as soon as the claim is lodged, not when the repairer calls
  • Ask for delivery in the morning, so you have the car before school pick-up
  • Confirm the drop-off point for the damaged car at the same time
  • If you are flying out, arrange delivery before you leave, not after you land
  • Keep the delivery time in writing, by text or email

If you are heading away for the holidays and the repair will run past your return date, tell the hire company now. Extending is straightforward if it is flagged early and documented. It is a fight if it is raised on the last day.

For the paperwork side of the arrangement, see what you sign in credit hire paperwork.

Keeping the hire reasonable with kids in the car

Credit hire is recoverable only to the extent it is reasonable. Insurers look hard at family hires because kids, holidays and long drives are exactly where reasonableness gets tested.

What keeps a claim clean:

  • Hire the car for the period your own car is genuinely off the road, not longer
  • Keep the tier sensible. A seven seat SUV is defensible; a top-spec performance SUV when you drove a base model is not
  • Do not use the hire car for a road trip that has nothing to do with replacing lost use. A Sydney to Byron run in the replacement car invites questions
  • Keep the car clean and undamaged. Photograph it at collection and at return
  • Do not let an unlisted driver use it. Check who is covered before you hand over the keys

One more thing that catches families out: tolls and fines. In New South Wales, toll notices and camera fines follow the driver, and they will find you through the hire company. Pay them promptly. An unpaid toll that escalates to a fine and then to a suspended licence is a much bigger problem than the original crash.

If the repair drags on, ask the repairer for a written update every week. A short email trail showing the car was still in the shop is the single best protection against a reasonableness argument later. See how long prestige car repairs take in Sydney for realistic timeframes.

Insurer arguments about need

The at-fault insurer will usually accept that you need a car. The argument is about how much car.

Common lines you will hear:

  • "A five seat sedan is sufficient for a family of five." It is not, if you carry seven people or tow.
  • "The hire rate is above market." Answer with the comparable rate for the same class of car in Sydney in that week.
  • "You did not need a car that size." Answer with photographs, school run schedules, sport commitments and the number of child seats.
  • "You should have claimed on your own insurance." You are not obliged to, and using your own policy can cost you your excess and your no-claim bonus.
  • "The hire went longer than necessary." Answer with the repairer's updates and parts delays.

The best defence is a file, not an argument. Keep the crash report, the claim number, the repairer's quotes and updates, the hire agreement, the delivery confirmation and your photographs. Send them when asked, promptly, and keep it factual.

If the insurer disputes the claim, the process is set out in when an insurer disputes a credit hire claim and dealing with insurers. You do not have to argue it alone, and you should not sign anything you do not understand.

If you are a repairer, solicitor or broker referring clients, the referral route is at partners and referrals.

What to photograph before you hand the car back

Return day is where small disputes become expensive ones. Ten minutes with your phone prevents most of them.

Photograph, in daylight:

  1. All four corners, from a step back, showing the whole panel
  2. Each wheel and tyre, including the tread and the rim faces
  3. The windscreen, for chips, and the roof
  4. The interior, including the seats, the third row and the boot floor
  5. The odometer, with the ignition on
  6. The fuel or charge gauge, at the same moment as the odometer
  7. Any pre-existing damage you noted at collection, in the same spot, from the same angle

Then check the car is clean, the child seats and your belongings are out, and the fuel matches what you agreed. Keep the photos for at least six months, and back them up somewhere that is not just your phone.

If you collected the car with a mark on the rear bumper and you have a photo from day one, the conversation at return takes thirty seconds. If you do not, it takes a month.

The same discipline applies at collection. Walk the car with the person delivering it, note every mark on the condition report, and photograph it before you drive away.

Where to go next if the crash just happened

If the crash was in the last day or two, the order of operations matters more than anything else on this page.

First, get the other driver's details, the registration, the insurer and a photo of their licence. Second, report to police if anyone was injured or the other driver left. Third, lodge the claim with the at-fault insurer and get a claim number. Fourth, arrange the replacement car before the repairer starts, not after.

The first 24 hours checklist is at the first 24 hours. If you are still working out whether credit hire is the right route, read credit hire versus claiming your own insurance and what is credit hire explained.

Bookings through this site are fulfilled by Drive Tribe (drivetribe.com.au), the trading name of Australian Business Holdings Pty Ltd, and this site is part of that group. The rate, the bond and every fee are shown on the car's page before payment, so there are no surprises at the counter. The bond equals the excess you choose, paying by card carries a small surcharge while bank transfer and cash on the rental do not, and cars can be booked from a single day.

If you are not sure what class of car you should be asking for, the by-type guide is at replacement by car type, and the full accident replacement range is at accident replacement car Sydney.

One last thing. Do not sign a release, a settlement or a deed without advice. Talk to your solicitor before you accept anything that closes the claim.

Questions people ask

Am I entitled to a seven seat replacement car?
If your own car is a seven seat vehicle and you were not at fault, you can generally claim a comparable seven seat replacement through credit hire. The entitlement is to restore the use you had, not to upgrade it, so the replacement should match the seating, layout and practical capability of your car. Insurers sometimes push back on the tier rather than the seat count, so keep photographs of your car loaded with people, prams or gear, and keep the school and sport schedules that show why you need the space.
Can I fit my own child seats to a hire car?
Yes. You can fit your own child seats to a replacement vehicle, provided you install them correctly and remove them before the car is returned. Check the anchor points before you accept the car, particularly in the third row, because some seven seat SUVs have top tether positions that are awkward for rear-facing seats. If your own child seats were damaged in the crash, photograph them and keep the receipts, as replacement seats can be a recoverable item in a not-at-fault claim.
What if no matching model is available?
You are entitled to a comparable car, not an identical one. If your exact model is not free, a seven seat diesel SUV or an eight seat people mover with similar space and capability is usually an acceptable substitute. Ask what is coming back and when, and weigh a short wait for the right car against weeks in the wrong one. Note the minimum driver age, which is 20 on most cars and 25 or 30 on some, and flag any younger driver in the household at the time of booking.
Does using credit hire affect my own insurance?
No. Credit hire is a claim against the at-fault driver's insurer, so it does not draw on your own policy, your excess or your no-claim bonus. That is the main reason not-at-fault drivers choose it over lodging a claim on their own comprehensive cover. You still need to notify your own insurer of the incident in most policies, but you are not obliged to claim through them. Read the credit hire paperwork carefully before signing, and ask questions about anything unclear.
How long can I keep the replacement car?
For as long as your own car is genuinely off the road, and no longer. That period runs from the day it goes in for repair to the day it is ready for collection, including any wait for parts. Keep the repairer's written updates so you can show the car was still in the shop. If the repair runs past a holiday you had already booked, tell the hire company early so the extension is documented rather than argued about later.
What should I do in the first 24 hours after a not-at-fault crash?
Swap details with the other driver, photograph both cars and the scene, note the time and location, and get the other driver's insurer and claim number if they have it. Report to police if anyone was injured or the other driver failed to stop. Lodge the claim, then arrange the replacement car before the repairer starts work. Keep every document in one folder, including the crash report, the claim number and the hire agreement, because insurers ask for them later.
