Credit hire after a crash during Vivid Sydney

If you are hit by another driver during Vivid Sydney, you can usually get a like-for-like replacement car on credit hire while your own car is repaired, even with road closures and event traffic management in place. The at-fault insurer normally pays the reasonable hire cost, and you pay nothing upfront when the claim is accepted.

Vivid runs for about three weeks from late May into mid June, and it changes how the city behaves. Crowds step off kerbs around Circular Quay and Barangaroo, rideshare drivers circle the Rocks, and closures on George Street, Macquarie Street and the Cahill Expressway approach turn a simple prang into a logistics problem. This is what to do, in order.

Key takeaways

  • You can arrange a like-for-like replacement car during Vivid; the closures affect the delivery point, not availability.
  • A pedestrian or cyclist causing the crash does not automatically end your not-at-fault claim, but evidence and witness details matter more than usual.
  • Get out of the event zone before exchanging details or calling a tow truck, and insist on a flatbed for a low prestige car.
  • Credit hire runs for the genuine repair period; if the car is written off, it ends at settlement.
  • Keep a dated diary from the night of the crash through to settlement; it is the most useful document in any dispute.

How Vivid changes traffic in the city and at Barangaroo

From about 6pm each night, the Sydney CBD stops behaving like a business district and starts behaving like a stadium with no gates. George Street northbound is largely closed to general traffic for the light rail and event zones, Macquarie Street is restricted around the Royal Botanic Garden, and the Cahill Expressway on-ramp at Circular Quay becomes a queue that backs onto the Bradfield Highway. Drivers who normally cut through the Rocks to avoid Kent Street find themselves in a one-way funnel with no exit.

Barangaroo is worse in a specific way. The Wulugul Walk and the headland park fill from about 5.30pm, and Wulumay Close and the surrounding service lanes become pedestrian priority. A car turning right off Sussex Street into Barangaroo Avenue at 6.30pm is turning into a crowd, not a street.

What this means for a crash: low-speed contact is the norm, but the aftermath is not. You cannot simply pull over and exchange details, because there is nowhere to pull over. You will be waved on by traffic controllers, and the other driver may keep moving. Your first job is to get the other car's registration and insurer if you can, then get yourself and your car out of the event zone before you do anything else.

If you are in a low car, remember the temporary bollards and fencing around event sites are not visible over a bonnet until you are close. A front lip on a Porsche or a BMW M car meets a concrete block at about 10 km/h and does thousands in damage. Drive the event zone at walking pace and assume every gap is about to close.

Crashes involving pedestrians and cyclists

During Vivid, the pedestrian is often the cause and the insurer is often confused about what to do with that. A person steps off the kerb on Pitt Street between Martin Place and King Street, mid-block, wearing dark clothing, looking at their phone. You are doing 20 km/h and you stop, but the cyclist behind you does not, or a rider runs a red on the Kent Street cycleway and clips your front quarter.

The legal position in New South Wales is not as simple as 'a pedestrian hit me, so it is their fault'. Contributory negligence is assessed on what a reasonable driver should have anticipated. In an event zone at night, a court will expect you to have anticipated pedestrians. That does not mean you are at fault, but it does mean the evidence matters.

What to collect at the scene:

  • Photographs of the scene from several angles, including the road layout, lighting and any event fencing.
  • The names and contact details of independent witnesses. Vivid crowds are an advantage here; there are usually twenty people who saw it.
  • Any police event number if officers attend. NSW Police often attend CBD collisions during Vivid because of the crowd management overlay.
  • Your own dashcam footage, saved immediately before it loops over.

If a pedestrian is injured, police will attend and statements will be taken. Do not admit fault at the scene, and do not argue. Give your version to police and your insurer, and let the evidence do the work. A not-at-fault claim can still proceed even where a pedestrian contributed, but the paperwork is heavier.

Closures that trap you after a prang

The hardest part of a Vivid crash is often not the crash. It is that the road you need to get your damaged car home or to a repairer is closed until 11pm or midnight, and the tow truck cannot reach you because the access lane is full of pedestrians.

What actually works on the night:

  1. Get out of the event zone first. Drive or roll to the nearest open street, even if it is 300 metres away. Sussex Street southbound, Bathurst Street and the western edge of the CBD are usually the last to close.
  2. Call your insurer's claims line and tell them you are in an event closure zone. Ask them to note it on the file. This matters later if there is any dispute about why you did not obtain a police report on the spot.
  3. If the car is not drivable, ask the tow operator to meet you at a nominated open street rather than the crash site. Be specific: 'the corner of Sussex and Bathurst' works; 'near Barangaroo' does not.
  4. Keep every receipt and every text. If you take a taxi or rideshare home because your car is undrivable and the trains are packed, that is a recoverable cost in a not-at-fault claim. It is a loss of use.

If you are in a prestige car, insist on a flatbed. A tilt-tray with a low front lip and no clearance will do more damage than the crash did. Tell the operator what the car is before they dispatch.

Once you are home, the replacement car question starts. Bookings are fulfilled by Drive Tribe (drivetribe.com.au), and this site is part of that group. That is the fleet you are booking from when you arrange a like-for-like car.

Rideshare and taxi crashes during Vivid

Rideshare and taxi drivers are everywhere during Vivid, and they are under pressure. Surge pricing, one-way systems and passengers who change the pickup point three times all produce the same behaviour: sudden U-turns on Kent Street, stopping in a clearway on York Street, and pulling out of the Rocks without looking because the app says the fare is waiting.

If a rideshare or taxi hits you, the claim is usually straightforward, but there are two complications. First, the driver may not be the registered owner, and the insurer may be a commercial policy rather than a private one. Get the registration, the driver's name, the operator's name and the policy details if they will give them. Second, the driver may try to settle privately to protect their rating or their account. Do not do that. A private settlement leaves you with no recovery if the repair cost rises after the car is stripped.

If a passenger opens a door into your car, that is still a collision. The door is part of the vehicle. Get the registration and the operator, and photograph the door and the damage together in one frame.

For a prestige car, the difference between a taxi and a private car is mostly about who pays and how fast. Commercial insurers often accept liability quickly because their driver's account is on the line. That said, do not sign anything at the roadside and do not accept a cash payment. Report it to your own insurer the same night.

Getting a replacement car during the festival

You can get a replacement car during Vivid. Road closures affect where the car is delivered, not whether it is available. The fleet is based at Mascot, Parramatta and Merrylands, and delivery to a home, office or repairer in the city is normal. What changes during the festival is the drop-off point.

Realistic delivery options during Vivid:

  • Meet the delivery driver at a location outside the closure zone. The corner of Sussex and King, or the northern end of Kent Street near the Western Distributor, usually works after 6pm.
  • Arrange delivery during the day. A 10am drop-off at a CBD office or a Surry Hills address is far easier than a 7pm drop-off at Circular Quay.
  • Have the car delivered to the repairer handling your car. That way you collect it where your own car is being assessed and you can talk to the assessor in person.

The car itself should match what you were driving. If your car was a large luxury sedan, a large luxury sedan is the like-for-like answer. If it was a performance car, the replacement should be a performance car. That principle is the whole point of credit hire, and it is worth reading the plain-English explanation on like-for-like before you accept anything smaller.

Where a specific car is the natural next step, the fleet has options that suit the city at night.

Parking a prestige replacement car in the city at night

This is the part nobody warns you about. You have a replacement car, it is a prestige car, and you live in an apartment in Pyrmont with a car space that was designed for a Corolla. Or you have no off-street parking at all and the street outside is an event clearway until midnight.

Practical rules for the festival period:

  • Check the height and width of your building's car park before the car is delivered. Older buildings in the Rocks, Millers Point and Potts Point have tight ramps and low clearance. A large luxury sedan will fit most; a wide performance car with a low splitter may not.
  • Do not leave a prestige car on the street in an event zone overnight. Clearway towing during Vivid is enforced, and a towed prestige car is an expensive and slow recovery.
  • Use a commercial car park with a known clearance and a boom gate rather than a ticket machine on the street. Wilson Parking and Secure Parking sites around Kent Street and Shelley Street are used to prestige cars.
  • Photograph the car inside and out before you drive it away, and again when you return it. This protects you on the condition report.

If parking is genuinely impossible, say so when you book. Delivery to a suburban address or a repairer outside the CBD is often the better answer for the duration of the festival. The rate, the bond and every fee are shown on the car's page before payment, so there are no surprises on that side.

Dealing with event traffic management

Transport for NSW and the event traffic management contractors run the closures, and they are not the police and not the insurer. They will not take a report, and they will not determine fault. What they can do is move you on, and they will.

If a traffic controller directs you through a red light or into a closed lane and you collide with another vehicle as a result, that direction is part of the factual matrix. Get the controller's name or the contractor's name if you can, and note the time and location. It does not automatically make the event organiser liable, but it is evidence about why you were where you were.

If your car is damaged by temporary event infrastructure, such as a bollard, fencing or a sign that has blown over, that is a different claim again. Photograph the object, the damage and the location in one sequence, and report it to the event organiser as well as your insurer.

For the claim itself, the key point is that event traffic management does not change the not-at-fault rules. Fault is still about who failed to take reasonable care. What it changes is the evidence: more witnesses, more camera coverage, and more chance that someone else saw what happened. The general principles are set out on not at fault explained and what not at fault means in NSW.

What to do the next morning

By the morning after a Vivid crash, the streets are open again and the crowd is gone, but your file is just starting. Work through this in order.

  1. Write down everything you remember while it is fresh: time, location, direction of travel, weather, lighting, what the other driver did, what the witnesses said, what the traffic controller said.
  2. Save your dashcam footage to your phone or laptop. Do not rely on the card in the camera.
  3. Lodge the claim with your own insurer. Give them the other driver's details, the police event number if you have one, and the names of any witnesses.
  4. Arrange the replacement car. If the other driver is clearly at fault, credit hire is usually the right path. If fault is unclear, read credit hire vs claiming your own insurance before you decide.
  5. Get your car assessed at a repairer who knows prestige cars. Ask what the likely repair time is, because that sets the hire period.
  6. Keep a simple diary of dates: crash, claim lodged, assessment, repair start, hire start, hire end. It is the single most useful document in a disputed claim.

If the other insurer contacts you directly, be polite and be brief. Refer them to your insurer or your credit hire provider. Do not give a recorded statement about fault without advice.

The full sequence is set out in first 24 hours, and the paperwork you will be asked to sign is explained on what you sign. For the wider picture on how the at-fault insurer ends up paying, see not at fault accident replacement.

How long credit hire runs after a Vivid crash

Credit hire runs for as long as your car is genuinely off the road, and no longer. In a normal Sydney repair, that is often two to six weeks. After a Vivid crash it can stretch, because prestige repairers in Alexandria, Artarmon and Silverwater are busy in June and parts for European cars can take time to arrive.

What controls the timeline:

StageTypical timing
Claim lodged and liability accepted1 to 10 business days
Assessment and authority to repair2 to 7 days after acceptance
Parts arrival for a prestige model3 days to 3 weeks
Repair itself1 to 4 weeks depending on damage
Hire periodMatches the repair period

If the car is declared a write-off, the hire period ends when the settlement is paid, not when you find a new car. That catches people out. Read credit hire and write-offs before you assume the hire continues indefinitely.

The at-fault insurer can dispute the length of hire, particularly if the repair was delayed for reasons unrelated to the crash. Keep your diary, respond to reasonable requests, and do not extend the hire for convenience. If a dispute does arise, the process is explained on when an insurer disputes a credit hire claim.

For a realistic view of prestige repair times in Sydney, see how long prestige car repairs take.

Your next step if you were hit during Vivid

You do not have to accept a small hatchback while your car is repaired just because the city is crowded and the insurer is slow. If the other driver was at fault, the law supports a like-for-like replacement and the at-fault insurer normally pays the reasonable cost of it.

Start by confirming the basics: the other driver's details, your own claim number, and a repairer who knows your car. Then arrange the replacement. The fleet covers prestige, performance and luxury cars, with delivery available across Sydney, and cars can be booked from a single day if that is all you need.

Check availability at accident replacement vehicles, or read more about how the process works on how credit hire works and the credit hire timeline. If you are a repairer, solicitor or broker who refers clients, the referral process is on partners and referrals.

Questions people ask

Can I get a replacement car during Vivid road closures?
Yes. The closures affect where the car can be delivered, not whether one is available. Arrange delivery outside the closure zone, such as the corner of Sussex and King Streets, or have it delivered to your repairer or a suburban address during the day. Delivery to a CBD office at 10am is much easier than a 7pm drop-off at Circular Quay.
What if a pedestrian caused the crash?
You can still make a not-at-fault claim, but contributory negligence will be assessed on what a reasonable driver should have anticipated in an event zone at night. Collect witness details, photographs and dashcam footage. If police attended, give your version to them and do not admit fault at the scene. The claim proceeds, but the evidence needs to be stronger.
Does event traffic management affect my claim?
It does not change the not-at-fault rules; fault is still about who failed to take reasonable care. It does change the evidence. There are usually more witnesses and more camera coverage in an event zone. If a traffic controller directed you into a closed lane, note their name or contractor and the time, as that context can matter later.
What if a rideshare driver hit me and wants to settle privately?
Do not settle privately. Get the registration, the driver's name, the operator and the policy details if offered, then report it to your own insurer the same night. A private payment leaves you with no recovery if the repair cost rises once the car is stripped. Commercial insurers often accept liability quickly because the driver's account is on the line.
How long can I keep the replacement car?
For as long as your car is genuinely off the road being repaired, and no longer. In Sydney that is often two to six weeks, and prestige repairs can run longer in June when repairers are busy. If your car is declared a write-off, the hire period ends when the settlement is paid, not when you buy a new car.
Where can I park a prestige replacement car in the city at night?
Use a commercial car park with a known clearance and a boom gate rather than street parking in an event clearway. Check your building's ramp height and width before delivery, because older buildings in the Rocks and Potts Point can be tight. Photograph the car inside and out before you drive it away and again on return.
