Insurer hire car claim after a crash in the Riverina

If another driver caused the crash, you can usually claim a replacement car on the at-fault insurer while yours is repaired, and in the Riverina that means sorting out delivery and repair logistics as much as the claim itself. The claim is against the other driver's insurer, not yours, and you are not limited to whatever courtesy car they happen to mention.

This page covers the crash risks on the Sturt and Hume Highways, what to do in the first hours, how insurers handle Riverina claims, getting a replacement car to Wagga Wagga or Griffith, repairer options, how long you can keep the car, and what to do when liability is disputed.

Key takeaways

  • If the other driver was at fault, you can generally claim a comparable replacement car on their insurer while yours is repaired, regardless of where in the Riverina the crash happened.
  • Delivery is available to Wagga Wagga, Griffith, Albury, Leeton, Narrandera and surrounding towns, usually arranged to coincide with your car going in for repair.
  • You are not obliged to use the insurer's preferred repairer, and in the Riverina there are often good reasons not to.
  • The replacement car is yours for the reasonable repair period, and parts freight and assessor travel in the regions are legitimate reasons the period runs longer.
  • If liability is denied or the offer is low, get advice early rather than arguing with the insurer for months.

Crash risks on the Sturt and Hume Highways

The Riverina is defined by two roads. The Hume Highway carries Sydney to Melbourne traffic through Gundagai, Tarcutta, Holbrook and Albury. The Sturt Highway runs west from Sydney through Wagga Wagga, Narrandera, Darlington Point and on to Griffith and Mildura. Both mix heavy vehicles, caravans, tourists and local traffic, and that mix is what produces most of the crashes we see.

Specific risk spots worth knowing:

  • Tarcutta and the Tarcutta Hills, where the Hume climbs and descends and trucks slow sharply in the left lane.
  • The Sturt Highway between Wagga Wagga and Narrandera, a long, flat, boring stretch that invites fatigue and overtaking on marked lines.
  • The Gobbagombalin Bridge and the Sturt Highway approach into Wagga Wagga, where local traffic merges with highway traffic at speed.
  • Griffith's irrigation channels and the Kidman Way, where farm machinery and utes pull out of paddocks with poor sight lines.
  • Harvest season from October to December, when grain trucks run hard on the Newell and Sturt and roads carry more agricultural traffic than at any other time.
  • Kangaroos and wombats at dawn and dusk, particularly on the Sturt west of Narrandera and around Leeton and Yanco.

Agricultural traffic is the factor insurers in Sydney often underestimate. A collision with a tractor, a header or a loaded grain truck involves machinery that may not be insured in the ordinary way, and the at-fault party may be a farming business rather than an individual. That changes who you are dealing with, not your right to a replacement car.

If you drive something worth replacing properly, the vehicle you get while yours is off the road should be comparable to what you lost. That principle is set out in our guide to like-for-like replacement.

What to do after a crash in the Riverina

In the Riverina, distances matter. You might be 40 kilometres from the nearest town and 200 from a repairer who can handle a prestige car. Work through this in order.

  1. Stop, check for injuries and call Triple Zero if anyone is hurt. Police attend serious crashes on the Hume and Sturt.
  2. Move to a safe spot if the vehicles can be moved. On the Hume, get well off the carriageway and behind the barrier if there is one.
  3. Exchange names, addresses, licence details, registration and insurer for every driver involved, including the driver of a truck or farm vehicle.
  4. Photograph everything: all vehicles from several angles, the road surface, skid marks, signage, the position of the sun, and any load or machinery involved.
  5. Collect independent witnesses. On the Sturt and Hume, other drivers often stop, and a witness who saw the other car cross the centre line is worth more than any argument later.
  6. Report to police if anyone was injured, if a driver failed to stop or exchange details, or if the crash is otherwise reportable in New South Wales.
  7. Notify your own insurer and, if you intend to claim against the other driver, get the claim moving the same day.

Do not admit fault at the scene, even if you think you might have contributed. Liability is decided later, and a casual apology on the roadside has a way of reappearing in a claim file. If you are unsure what to say, say nothing about fault and stick to exchanging details.

Our first 24 hours guide walks through the same steps with more detail on evidence and notifications, and what to do after a not-at-fault accident covers the decisions that follow.

How insurers handle Riverina claims

Most insurers who write policies in the Riverina are Sydney or Melbourne based. Their assessors and case managers may know the Hume well and the Sturt barely at all. That shows up in three ways.

First, repairer networks thin out west of Wagga Wagga. An insurer's preferred repairer list may include one shop in Wagga Wagga and nothing in Griffith, Leeton or Deniliquin. Second, replacement car logistics get harder: a Sydney-based insurer may offer a small hatch from a depot that does not exist in the Riverina, then take days to work out how to get anything to you. Third, liability investigations move slowly when the at-fault driver lives in another town, or is a business, or is insured through a rural broker who is only in the office three days a week.

What you are entitled to does not change because the insurer is unfamiliar with the area. If the other driver was at fault, you can generally claim a replacement car of comparable standard while yours is repaired, and the at-fault insurer meets the reasonable cost. Credit hire is the mechanism that makes this work when the insurer will not put you in a car directly.

If you need a car now, you can review availability directly: accident replacement cars are delivered to the Riverina from the Sydney fleet. Bookings are fulfilled by Drive Tribe (drivetribe.com.au), the trading name of Australian Business Holdings Pty Ltd, and this site is part of that group.

Understanding the mechanism matters because it decides who you call first. See how credit hire works and what credit hire is.

Getting a replacement car to Wagga Wagga or Griffith

Delivery is the practical question in the Riverina. A prestige replacement car can be delivered to your home, your workplace or the repairer, in Wagga Wagga, Griffith, Albury, Leeton, Narrandera, Temora, Cootamundra, Young, Deniliquin or Hay. The car comes from the Sydney fleet, so the delivery is arranged rather than instant, and the timing depends on when you confirm the booking.

What usually works best:

  • Have the car delivered to the repairer on the morning your car goes in, so you hand one over and drive the other away.
  • If your car is not drivable, arrange delivery to your home address and have the damaged car collected separately.
  • Confirm the delivery address, access and any gate codes in advance. Rural properties and farm driveways are not always straightforward for a car carrier.
  • Keep the delivery and collection paperwork. It forms part of the hire record if the claim is later scrutinised.

For a Riverina run, a vehicle that handles distance and load makes sense. The Ford Ranger Wildtrak is a common choice for people who need a tray and a proper 4x4 for farm tracks and gravel, and the Chevrolet Silverado 1500 Trail Boss suits heavier towing and larger loads.

Repairer options in the Riverina

Wagga Wagga has the deepest repairer bench in the region, with several shops that handle prestige and performance vehicles, including panel and mechanical work for European marques. Griffith has capable local repairers, and Albury has a strong set of shops on the New South Wales side of the border. Smaller towns such as Leeton, Narrandera, Temora and Cootamundra generally handle mainstream repairs well but may not have the equipment or the trained technicians for a late-model German car, an aluminium-bodied vehicle or complex electronics.

You are not obliged to use the insurer's preferred repairer. In New South Wales you can choose your own repairer, and the insurer is entitled to a reasonable opportunity to assess the damage and to expect market rates. What the insurer cannot do is insist you use their shop when you have a good reason not to.

Good reasons in the Riverina include:

  • The nearest preferred repairer is 150 kilometres away and the car is not drivable.
  • The preferred repairer does not have manufacturer approval or the diagnostic equipment your car needs.
  • Your chosen repairer can start sooner, which reduces the hire period and therefore the claim cost.
  • The damage involves structural or aluminium repair that only certain shops can do.

Get the assessment done early. An insurer that cannot inspect the car for two weeks is an insurer that will argue about the hire period later. Our pages on insurer preferred repairer rights and repairs and write-offs set out the detail.

How long you can keep the replacement

The replacement car is there for the reasonable time your car is off the road. In practice that means from the day your car goes in for repair, or from the day it is assessed as a write-off, until it is repaired and returned or the claim is settled.

What counts as reasonable depends on the work, not on the insurer's convenience. A prestige car with parts coming from Germany or Japan, or with a specialist repairer booked out for weeks, takes longer than a Commodore with a dented guard. Insurers sometimes try to cap the hire at a set number of days regardless of the repair, and that argument usually fails when there is evidence the delay was genuine.

Things that stretch the timeline in the Riverina:

  • Parts freight to a regional repairer, which can add days at each stage.
  • Assessment delays when the insurer's assessor has to travel from Sydney or Melbourne.
  • Repairer backlogs after a hailstorm or a run of crashes on the Hume.
  • Supplementary damage found once the car is stripped, which requires a second assessment and a second approval.

Things that shorten it: choosing a repairer who can start immediately, approving the repair promptly once the assessment is done, and keeping the hire car until the day your car is actually returned rather than the day the repairer says it should be finished.

If the insurer is dragging its feet, see insurer delays and the replacement car and the hire car claim timeline. If your car is declared a write-off, the position changes and write-off offers is the place to start.

If the insurer disputes liability

Liability disputes are common in regional crashes for a simple reason: the two drivers often give different accounts and there is no CCTV, no independent witness and no police attendance. The insurer then decides on the balance of probabilities and may deny liability outright or offer a partial split.

What helps in the Riverina:

  • Photographs taken at the scene, especially of vehicle positions, road markings and signage.
  • Any dashcam footage, including from the other vehicle if it can be obtained.
  • Names and contact details of witnesses, even if they did not stop and you only got a first name and a town.
  • The police event number if police attended or a report was made.
  • An early statement from you, written while the detail is fresh.

If the at-fault driver is from Sydney, or is a business, the insurer may take longer to make contact. That does not mean the claim is weak. It means the file moves slowly. Keep the pressure on with written follow-ups and keep a record of every call, including the date, the time and the name of the person you spoke to.

Where an insurer denies liability, the arguments and the rebuttals are usually predictable. Our pages on liability disputes and insurer arguments and rebuttals set out the common positions and how to answer them. Insurer disputes in a hire car claim covers what to do next, and complaints and escalation deals with the formal steps if the dispute does not resolve.

When to get legal help

Most not-at-fault claims in the Riverina do not need a solicitor. The insurer accepts liability, the car is repaired, the hire is paid and the file closes. Legal help becomes worthwhile when the claim stops being routine.

Get advice if:

  • Liability is denied and the insurer will not move, especially where the evidence is genuinely contested.
  • The insurer is offering a low settlement that does not reflect the vehicle's condition, options or history.
  • Your car is a write-off and you disagree with the assessed value.
  • The at-fault driver is uninsured or cannot be identified, including a hit-and-run on the Hume or Sturt.
  • There is an injury, or the crash involved a fatality or serious injury.
  • The other vehicle was farm machinery or a commercial truck with a complex insurance arrangement.

A solicitor can take over correspondence, issue proceedings if needed and deal with the insurer directly. For a prestige car, the difference between a low offer and a proper one is often large enough to justify the cost. General information only: talk to your solicitor about your circumstances, and to your accountant if the claim has tax implications, particularly for business vehicles.

See when to get a solicitor and low-ball equivalence offers. If you run a fleet and want a referral arrangement, start with partners and referrals and business and fleet.

Questions people ask

Can I get a replacement car delivered to my home in Wagga Wagga?
Yes. Delivery is available to home addresses, workplaces and repairers across Wagga Wagga and the wider Riverina, including Griffith, Albury, Leeton, Narrandera, Temora and Cootamundra. The car comes from the Sydney fleet, so the delivery is arranged rather than instant. Confirm the address, access and any gate codes in advance, and keep the delivery and collection paperwork as part of the hire record.
What if the at-fault driver is from Sydney?
It makes no difference to your entitlement. The claim is against that driver's insurer, and most insurers who write policies in New South Wales handle claims statewide. It can slow things down, because the insurer may want to interview their own customer in Sydney before accepting liability. Keep written records of every contact and follow up regularly. If the delay becomes unreasonable, see our page on insurer delays.
How long does a hire car claim take in the Riverina?
A straightforward claim where liability is accepted can be sorted within days, with the replacement car in place when your car goes in for repair. Disputed liability, a write-off or parts delays can stretch it to weeks. The hire period itself runs for the reasonable repair time, so a prestige car waiting on overseas parts will be off the road longer than a mainstream vehicle.
Do I have to use the insurer's preferred repairer?
No. In New South Wales you can choose your own repairer. The insurer is entitled to a reasonable opportunity to assess the damage and to expect market rates, but it cannot force you to use its shop when you have a good reason not to. Distance to the nearest preferred repairer, lack of manufacturer approval or diagnostic equipment, and a shorter repair wait are all legitimate reasons.
What if my car is declared a write-off?
The replacement car arrangement changes once the car is a write-off, because the repair no longer exists to measure the hire period against. The focus shifts to the write-off offer and whether it reflects the vehicle's true value. If you disagree with the assessed value, get advice before accepting. Our page on insurer write-off offers covers the usual arguments.
Can I claim a replacement car if the at-fault driver is uninsured?
It is harder but not always impossible. If the driver cannot be identified or has no insurance, you may need to look at your own policy, including any uninsured motorist cover, and at whether the other driver can be pursued personally. This is one of the situations where a solicitor is worth consulting early, particularly if the vehicle is valuable or the crash caused injury.
