If your car is written off after a crash that was not your fault, you are still owed the use of a comparable car while the claim is sorted, and in NSW that does not stop the moment an assessor declares the wreck a total loss. The at-fault party owes you damages for loss of use, and a written-off car does not extinguish that.

This is the sequence a Sydney prestige owner actually goes through: the tow yard, the assessor's call, the payout negotiation, the salvage question, and the replacement car that keeps you mobile until the money lands and the next car is in your garage.

Key takeaways

  • A written-off car does not end your loss of use claim; the at-fault party still owes you a comparable car until you are mobile again.
  • Repairable and statutory write-offs have very different consequences, and only one can ever be re-registered in NSW.
  • Do not accept a settlement figure on the phone, and never sign a release that covers all claims arising from the accident.
  • Keep the replacement car until the next car is registered and in your hands, not until the payout is agreed.
  • Get a solicitor involved if liability is disputed, the offer is well below retail, or your hire claim is refused because the car was written off.

What written off actually means in NSW

In NSW, "written off" is not one thing. It is a commercial decision by an insurer, and it is a statutory category applied by Transport for NSW. They are related but they are not the same, and the difference matters to you.

An insurer writes a car off when the cost of repairing it, plus the cost of a hire car for the repair period, plus any salvage and towing, gets close to or exceeds the car's market value. On a prestige car, that threshold arrives faster than most owners expect, because parts are expensive and repair times are long. A 2021 BMW M3 Competition with a bent rear quarter and a damaged subframe can be economically repairable in a workshop sense and still be written off by the numbers.

Transport for NSW then applies its own test. If the vehicle is damaged to the extent that it is not safe to repair, or the repair would not restore it to a roadworthy standard, it is recorded on the written-off vehicle register. That register is national. It follows the car, not the owner.

The practical point for a Sydney driver: the assessor's call is about money, the register is about safety, and your claim for loss of use runs on its own track regardless of either. If you are still working out where you stand, our not at fault explained page sets out the basics, and what not at fault means in NSW covers the statutory side.

Repairable write-off versus statutory write-off

These two labels get used interchangeably in conversation and they should not be. The consequences are very different, especially if you want to buy the wreck back or keep driving something similar.

CategoryWhat it meansCan it go back on the road?
Repairable write-offInsurer decided not to repair on cost grounds, but the damage is repairable to a safe standardYes, but it must pass a written-off vehicle inspection and be re-registered
Statutory write-offDamage is such that it is not safe or economic to repair, or the structure is compromisedNo. It cannot be re-registered in NSW

A repairable write-off is common on older prestige cars where the repair bill is high relative to market value. A statutory write-off is common after a heavy hit, a fire, a flood, or where the monocoque is distorted. If you are weighing up whether to repair or take the money, the repairable write-off NSW guide walks through the inspection process, and statutory write off NSW: what happens next covers the end of the road case.

Do not assume the insurer's category is final. If you believe the car is repairable and you want it back, say so early, in writing, before you accept anything.

The moment the assessor calls it: what to do that day

The call usually comes from a assessor or a claims consultant, often within a few days of the car being towed. It goes something like: "We have assessed your vehicle as a total loss. We will be in touch about settlement." That is the moment to slow down and get organised.

  1. Write down the time, the name and the direct number. Ask for the assessment report and the market valuation in writing.
  2. Do not accept a settlement figure on the phone. You are not obliged to agree to anything in that call.
  3. Photograph everything you can still access: the car at the tow yard, your own pre-accident photos, the service history, the options list, the odometer.
  4. Tell them you are claiming loss of use and that you will need a replacement car of comparable standard. Put it in an email so there is a record.
  5. If you have not already, get your own evidence in order. Our evidence to collect at the scene page is a useful checklist even if the crash was a week ago.

If the car is sitting at a tow yard in Alexandria, Silverwater or Banksmeadow, storage starts accruing. Ask who is paying for storage and get that confirmed in writing, because it will be raised against your settlement if nobody owns it.

Why your replacement car does not end when the car is written off

This is the part most insurers will not volunteer. Loss of use is a head of damage separate from the value of the car. The at-fault driver owes you the value of the car you lost, and also the reasonable cost of having a comparable car available while you are without one. Writing the car off changes the first number. It does not erase the second.

In practice, that means a prestige owner whose car is declared a total loss can keep a like-for-like replacement on the road while the payout is negotiated, while the next car is sourced, and while it is delivered. The clock does not stop at the assessor's call. It runs until you are back in a comparable vehicle.

Where the claim is handled through credit hire, the replacement is provided on a deferred basis and the hire company recovers from the at-fault insurer later. Our how credit hire works page explains the mechanics, and how long can you keep a replacement car deals with the timeline question directly.

Agreeing a payout figure without giving away your hire claim

The settlement offer for the car and your loss of use claim are two separate negotiations. Insurers like to bundle them. Do not let them.

When you get a market valuation, check it against actual Sydney retail. A 2015 Mercedes-Benz S500 L with low kilometres and full service history is not the same as a high-kilometre example with a repaired front end. Gather three comparable listings from NSW dealers, note the asking prices, and send them through. Ask for the valuation methodology. If they used a trade-in figure rather than a retail figure, say so.

Then keep the hire claim separate. If you are asked to sign a deed of release or a settlement discharge, read it for words like "full and final settlement of all claims arising from the accident". That language can extinguish your loss of use claim along with the car. If it appears, do not sign until you have had it looked at.

If the offer is low, say so in writing and give your reasons with evidence. Our dealing with insurers page covers the escalation path, and cash settlement vs repair not at fault sets out when taking the money is the better call.

Salvage, the wreck and who keeps it

Once the insurer pays you the market value, the wreck usually becomes theirs. They will sell it at auction or to a salvage buyer, and that recovery is part of how they manage the claim. If you want to keep the car, you can ask to buy the salvage back, and the insurer will normally deduct a salvage value from your payout.

Think carefully before you do. On a statutory write-off, you cannot re-register the car in NSW no matter how much you love it. It becomes a parts car or a track car, and only if the category allows. On a repairable write-off, you can repair and re-register, but you will need to pass a written-off vehicle inspection, and the car will carry that history permanently. That affects resale, insurance premiums and finance.

If you do retain the salvage, arrange removal from the tow yard promptly. Storage at a Sydney yard can be charged daily, and those charges can end up in dispute. Get the release paperwork in writing before you send a tow truck, and confirm whether the yard needs the insurer's authority to release the vehicle.

If you are not keeping it, ask the insurer to confirm in writing that they have taken possession and that storage from that date is their responsibility. That one email saves arguments later.

Buying the next car while the claim is still open

You do not have to wait for the payout to start looking, and in the current Sydney market you probably should not. Prestige stock moves quickly, and the gap between finding the right car and having cleared funds can be a week or more.

Two practical points. First, keep your replacement hire car until the new car is actually in your hands and registered. Do not hand it back the day you agree a payout, because you will be stranded between settlement and delivery. Second, if you are financing the next car, talk to your broker early. A written-off vehicle on your record can affect approvals, and a statutory write-off can affect the trade-in you were planning.

If you are moving up or across, this is also the moment to think about what you actually want next. A Sydney owner coming out of a written-off performance sedan often wants something with the same punch but a different character. These are three that suit the gap well:

When to get a solicitor involved

Most not-at-fault write-offs in Sydney resolve without a solicitor. You deal with the insurer, agree a figure, keep a hire car running, and move on. There are situations where that stops being sensible.

  • The at-fault insurer denies liability or delays beyond a few weeks without a clear reason.
  • You are injured as well as out of pocket, or the crash involved a fatality or serious injury.
  • You are asked to sign a release that covers more than the vehicle.
  • The payout offer is well below retail and the insurer will not move.
  • Your loss of use claim is being refused on the basis that the car was written off.
  • There is a dispute about who was at fault, or a police investigation is running.

For the last point, the law is on your side but it helps to have someone put it in writing. If you are a smash repairer, broker or solicitor who refers clients, our partners and referrals page explains how that works. Fleet operators should read fleet vehicle repair and write off delays, because the loss of use calculation on a fleet vehicle is a different exercise.

If you are a fleet or business owner

A written-off vehicle in a business fleet is a productivity problem before it is an insurance problem. A sales rep without a car is a rep not making calls. A director without a car is a director catching trains to Parramatta for a meeting that should have taken twenty minutes.

The loss of use claim is the same in principle, but the evidence is different. You need to show what the vehicle was doing, what it was worth to the business, and what it cost to replace its function. Log books, booking records and the replacement hire invoices all matter. Our business and fleet page covers the structure, and fleet vehicle repair and write off delays goes into the timetable.

Where a fleet car is a statutory write-off, the replacement decision usually happens faster than the payout. Many operators put a like-for-like hire car on the road the same week and sort the settlement in parallel. That keeps the business moving and keeps the loss of use claim honest, because the hire is doing exactly what the written-off car was doing.

If you are running several vehicles, get the claims and the hires coordinated rather than handled one at a time. It is the difference between a bad month and a bad quarter.

The first 24 hours after the tow

Most of the mistakes that cost prestige owners money happen before the assessor is even involved. If the car has just been towed, this is the order to work in.

  1. Confirm where the car is. Get the tow company name, the yard address and the daily storage rate in writing.
  2. Report to police if anyone was injured, if the other driver failed to stop, or if there is a dispute about fault. Get the event number.
  3. Notify your own insurer, even if you are claiming through the at-fault party. You are usually required to, and it protects you if liability is disputed.
  4. Collect the other driver's details, photos of both cars, and any dashcam or witness details.
  5. Do not sign anything from the at-fault insurer on day one. You are not obliged to accept their assessment or their repairer.
  6. Arrange a replacement car of comparable standard. Do not wait for the payout.

Our first 24 hours page is the detailed version, and replacement by area covers delivery across Sydney. If you want to see what is available now, accident replacement car Sydney shows current cars, and how long can you keep a not at fault replacement car in NSW answers the timeline question.

Questions people ask

Can I keep my replacement car after my car is written off?
Yes, in most not-at-fault cases. Loss of use is a separate head of damage from the value of the car, so writing the vehicle off does not automatically end your entitlement to a comparable replacement. The hire normally continues while the payout is negotiated and while you source and take delivery of your next car. Keep the hire until the new car is registered and in your hands, then return it. If the at-fault insurer tells you the hire stops at the write-off, ask them to put that in writing.
Does the at-fault insurer pay for a hire car after a write-off?
They are liable for your loss of use, which includes a comparable replacement while you are without a car. In practice, the hire is often arranged through credit hire, where the provider is paid later by the at-fault insurer. The at-fault insurer may try to cap the hire at a few days or refuse it once the car is written off. That position is not automatically correct. Keep the hire reasonable, keep the car like-for-like, and keep the invoices.
What if I disagree with the write-off payout?
Ask for the valuation in writing and the method used. Gather three comparable NSW retail listings for the same model, year and similar kilometres, and send them through with your service history and options list. Ask them to revise. If they will not move, you can escalate internally, complain to the relevant dispute body, or instruct a solicitor. Do not sign a release while the figure is in dispute, and keep your hire running while you negotiate.
What is a statutory write off in NSW?
A statutory write-off is a vehicle Transport for NSW has recorded as unsafe or uneconomic to repair to a roadworthy standard. It cannot be re-registered in NSW, and the record is national. It is different from a repairable write-off, which can go back on the road after passing a written-off vehicle inspection. If your car is a statutory write-off, the practical outcome is a payout and a search for a replacement, not a repair.
Can I buy the wreck back from the insurer?
Often yes, by asking for the salvage value to be deducted from your payout. Whether it is worth it depends on the category. A statutory write-off cannot be re-registered in NSW, so it is only useful as parts or a track car. A repairable write-off can be repaired and re-registered after inspection, but it carries the written-off history permanently, which affects resale and insurance. Get the salvage figure in writing before you decide.
How long does a not-at-fault write-off claim take in Sydney?
It varies. Straightforward claims with clear liability and agreed values often settle in two to four weeks. Disputed liability, low offers or a slow assessor can push it to two or three months. The replacement car should not be tied to that timeline. Keep it running while the claim is open, and return it once your next car is registered and delivered. If the claim drags with no clear reason, that is a signal to escalate.
