Replacement car after a crash in Campbelltown

If you were hit by another driver in Campbelltown, you can arrange a replacement car at no cost to you while your own vehicle is repaired or written off. Not-at-fault replacement hire is a well-established part of the NSW claims system, and it applies just as much in Macarthur as it does in the city.

This page covers what to do at the scene on the Hume Highway or Narellan Road, how delivery to your driveway in Glen Alpine or Harrington Park works, what local repairers and timelines look like, and how to handle an insurer who says no. It is written for drivers of prestige, performance and family cars worth replacing properly.

Key takeaways

  • You can arrange a prestige replacement car after a not-at-fault crash in Campbelltown, with delivery across Macarthur and south west Sydney.
  • You choose the repairer and the replacement vehicle; the at-fault insurer does not get to dictate either.
  • The hire runs for as long as your car is genuinely off the road, or for a reasonable period after a write-off.
  • The rate, bond and every fee are shown on the car's page before payment, and the bond equals the excess you choose.
  • If an insurer refuses, ask for the reason in writing and escalate to AFCA or a solicitor rather than arguing on the phone.

Campbelltown crash hotspots: Hume Highway, Narellan Road, Appin Road

Most not-at-fault crashes we see involving Campbelltown drivers happen in a handful of places, and knowing them helps you describe the incident clearly to your insurer and to us.

  • Hume Highway and Hume Motorway interchanges around Campbelltown Road, Brooks Road and Raby Road. High speed, heavy truck volumes, and rear-end shunts when traffic compresses near the Menangle Park on-ramps.
  • Narellan Road between the university and Narellan. Multi-lane, constant lane changes, and a lot of side-swipes at the lights near Macarthur Square and the hospital turn-off.
  • Appin Road through Bradbury, Rosemeadow and into Appin. Two lanes, crests, and right-turners into driveways that get collected from behind.
  • Queen Street and the Campbelltown CBD around the railway station and the hospital. Low-speed carpark and intersection hits, plus a steady stream of carpark scrapes at Macarthur Square.
  • Camden Valley Way and the Northern Road for anyone commuting towards the airport or Liverpool.

Peak times matter for the report. The 7.30am to 9am run towards the M5 and the 4.30pm to 6.30pm return are when most of these happen, and the queue on Narellan Road westbound at 5pm is where a lot of rear-end damage starts.

If your car is a prestige or performance model, get the other driver's details and photograph everything before anyone moves. A rear bumper on a European SUV is not a cheap panel, and the difference between a repair and a write-off often comes down to the photos taken in the first ten minutes.

What to do at the scene

You are not required to admit fault, and you should not. Exchange names, addresses, licence numbers, phone numbers, registration numbers and insurers. If the other driver will not cooperate, call Campbelltown Police Station or the police assistance line and get an event number.

  1. Make the scene safe. Hazard lights on, get out of live lanes, and keep clear of the Hume Highway shoulder.
  2. Photograph the position of both cars, all damage from several angles, the road surface, lane markings and any street signs.
  3. Photograph the other driver's licence and rego sticker or plate. If they have a company vehicle, get the company name.
  4. Note the time, the weather and the traffic conditions. Note whether the sun was in your eyes, because that comes up.
  5. Get names and numbers of any witnesses, especially anyone stopped at the lights who saw the impact.
  6. Do not arrange your own tow from the Hume. If the car is undriveable, the police or your insurer will organise recovery. Tow operators who appear uninvited at Macarthur Square or the Appin Road shoulder are a known problem, and signing their paperwork can create a storage bill you did not agree to.

Once you are safe, report the crash to your insurer and, if you intend to claim replacement hire, to the at-fault driver's insurer as well. Keep every reference number. Our guide to the first 24 hours after a not-at-fault crash walks through the sequence in detail.

Getting a replacement delivered

Campbelltown is not a problem for delivery. Cars are brought to your home, your workplace, or the repairer holding your vehicle, anywhere from Campbelltown and Ambarvale out to Camden, Picton, The Oaks, Narellan, Gregory Hills, Oran Park and Appin.

Typical windows are same day for a morning crash if you call before about 2pm, and next morning for anything reported later. Delivery is usually to a driveway, a secure carpark or a repairer's yard. You will need a current Australian driver licence, be at least the minimum age for the car you choose, and have a card for the bond. The bond equals the excess you select, and the rate, the bond and every fee are shown on the car's page before you pay. Paying by card carries a small surcharge; bank transfer and cash on the rental do not.

If your car is a seven-seater and the family still has school runs to St Gregory's or Campbelltown Performing Arts High, matching the seats matters more than matching the badge. A luxury SUV is the usual answer.

Not at fault? Start your claim

A like-for-like replacement car while yours is repaired. No cost to you when the other driver is at fault.

Local repairers and timelines

You choose the repairer. Not the at-fault driver, not their insurer. That is the single most useful thing to know in a not-at-fault claim, and it is why Macarthur drivers are not stuck with whoever the other side prefers.

There is decent prestige capacity in the area. Panel shops around Campbelltown, Ingleburn, Smeaton Grange and Narellan handle European makes regularly, and many have manufacturer-approved equipment for aluminium structures and calibration of driver assistance systems. What they do not all have is capacity. A prestige repair in south west Sydney typically runs two to four weeks for panels and paint, longer if parts come from Germany or Japan, and longer again if the damage reaches the structure.

DamageTypical time off the road
Bumper, guard, paint match1 to 2 weeks
Multiple panels, sensors, radar recalibration3 to 5 weeks
Structural, airbags deployed6 weeks and up, or a write-off

Ask the repairer for a written estimate and an expected completion date before you commit, and send both to the insurer. If parts are on backorder, say so in writing, because that is the evidence that supports a longer hire. More on realistic timeframes is in how long prestige car repairs take in Sydney.

How long you can keep the car

You can keep a replacement car for as long as your own vehicle is genuinely off the road being repaired, or until the claim is resolved if it is written off. That is the principle the courts have settled on, and it is not a fixed number of days.

In practice, for a Campbelltown claim:

  • Repairable car: the hire runs alongside the repair, from drop-off to collection.
  • Parts delay: the hire continues while you wait, provided the delay is reasonable and documented.
  • Write-off: the hire continues for a reasonable period after the write-off decision while you sort a replacement, not indefinitely.
  • Dispute: if the insurer refuses, the hire can continue while the dispute is resolved, but you should get advice before running up a large bill.

Keep it honest. If your car is finished on a Tuesday, return the replacement on the Tuesday. Insurers look for reasons to reduce a hire claim, and an extra week of unexplained use is the easiest one to find.

If you are unsure whether your situation is still covered, our page on how credit hire works explains who carries the risk and when.

Common insurer responses

Most claims go through without argument. When they do not, the pushback is predictable, and so is the answer.

  • "We will only pay a daily rate." The test is like-for-like, not a flat rate. A driver of a large European SUV is entitled to something comparable, and the rate for that class is what it is.
  • "Use our preferred supplier." You are not obliged to. You choose the repairer and you choose the replacement.
  • "We did not authorise this hire." Authorisation is not required for a not-at-fault claimant to arrange reasonable replacement transport.
  • "The other driver has not admitted fault." Liability investigations take time, but that does not automatically stop a replacement.
  • "We are writing the car off, so the hire stops today." A reasonable run-off period after a write-off decision is normally accepted.

The legal foundation for like-for-like replacement in NSW comes from the line of authority including Arsalan v Rixon, which confirmed that a not-at-fault driver can recover the cost of a comparable replacement vehicle. Our plain-English summary is at not-at-fault explained, and the practical version is at like-for-like.

Keep every email. If an assessor rings, take notes with the time, the name and what was said. A written trail is what wins these arguments.

Escalating a dispute

If the at-fault insurer refuses to pay the hire, or pays part of it and leaves you with a gap, you have options short of court.

  1. Ask for the refusal in writing, with the reason and the clause they are relying on.
  2. Send a short, factual response with the repairer's estimate, the hire invoices, the police event number and your photos.
  3. Ask for an internal review by a senior claims officer, not the original assessor.
  4. If it is still refused, take it to the Australian Financial Complaints Authority. It is free, it is independent, and it handles hire car disputes regularly.
  5. For larger claims, or where the insurer is arguing about liability itself, get a solicitor who does motor vehicle property damage. Our insurer disputes page sets out what they will ask for.

Two practical rules. Do not sign anything from the at-fault insurer that releases them from further claims without reading it properly. And do not let a dispute run for months without telling the hire company, because someone is carrying that cost and it should not be you by surprise.

If you are a smash repairer, solicitor or broker in Macarthur and you refer clients regularly, see partners and referrals.

If your car is written off

A write-off in Campbelltown is common enough on the Hume, where a hit at 100 km/h does structural damage that a suburban crash would not. If your car is declared a statutory or economic write-off, the replacement hire does not stop the moment the assessor calls.

You are entitled to a reasonable period to find a replacement vehicle, settle with the insurer and get mobile again. What is reasonable depends on the circumstances, but a week or two is not unusual while you wait for a payout figure and shop for the next car.

Two things to watch. First, do not accept the first payout figure without checking comparable listings for your model, year and kilometres across Sydney. Second, if the car is financed, the payout goes to the financier first, and any shortfall is yours unless you have gap cover.

Write-offs also affect the hire claim. The at-fault insurer may argue the hire should have ended earlier, so keep the timeline tight and documented. Our repairs and write-offs page covers the process, and the Drive Tribe guide at drivetribe.com.au/written-off-not-at-fault/ explains what happens next.

Matching the replacement to your car

Like-for-like does not mean identical. It means comparable in size, seating, transmission, drivetrain and general standing. A Campbelltown family with three kids and a large SUV needs seven seats and a boot that takes school bags and a pram; a tradie with a dual-cab ute needs a tray and a tow bar.

Common swaps we arrange for Macarthur drivers:

Your carTypical replacement
Large European SUVBMW X7 or Mercedes-Benz GLS
Dual-cab uteBYD Shark 6 Premium
Mid-size family SUVToyota Kluger GX

If your own car is a performance model, say so at the start. A base SUV is not a fair substitute for an M car or an AMG, and the hire should reflect what you actually drive. See BMW M and AMG replacement cars and seven-seat SUV replacements.

Minimum driver age is 20 on most cars and 25 or 30 on some, so check the car's page before you book. Full details of the fleet are at drivetribe.com.au/accident-replacement-vehicles/.

Business fleets and Macarthur trades

If the damaged vehicle is a company car or part of a fleet, the process is the same but the paperwork matters more. A ute off the road in Smeaton Grange or a sales rep without a car in Narellan costs money every day, and that cost is recoverable as part of the claim in the right circumstances.

  • Keep the vehicle log and the driver's licence on file before the crash, not after.
  • Report internally the same day so the incident report matches the police report.
  • Tell your insurer and, separately, arrange the replacement. Do not wait for the at-fault insurer to act.
  • If you need several vehicles at once, say so early. Multi-car requests take longer to fill.

For fleet managers and business owners across Campbelltown, Ingleburn, Minto and Camden, our business and fleet page sets out how it works. If you would rather talk it through, contact us and we will confirm availability before you commit.

One last point on timing. The earlier you call, the better the choice. By Friday afternoon, the seven-seaters are usually gone, and a Monday morning crash on Narellan Road is much easier to solve than a Saturday night one.

Questions people ask

Is a replacement car available in Campbelltown?
Yes. Replacement cars are delivered to Campbelltown, Ambarvale, Rosemeadow, Glen Alpine, Harrington Park, Narellan, Gregory Hills, Oran Park, Camden, Picton and Appin, as well as to repairers across Macarthur. Delivery is included in the arrangement. Availability depends on the day and the class of car you need, so it is worth calling early, particularly for seven-seat SUVs and dual-cab utes.
How long does delivery take?
For a crash reported before early afternoon, same-day delivery is often possible. Anything later, or over a weekend, is normally next morning. Delivery goes to your home, your workplace or the repairer holding your car. You will need a current Australian driver licence, to meet the minimum age for the car, and a card for the bond.
What if my car is a write-off?
The replacement does not stop the moment the assessor calls. You are entitled to a reasonable period to find another car and settle the payout. Keep the timeline documented, because the at-fault insurer may argue the hire should have ended sooner. If the car is financed, the payout goes to the financier first and any shortfall is yours unless you hold gap cover.
Do I have to use the insurer's preferred repairer?
No. In a not-at-fault claim you choose the repairer. That is why many Campbelltown drivers use a local shop they trust rather than one nominated by the other side's insurer. Get a written estimate and an expected completion date, and send both to the insurer so the repair timeline is on record.
What if the other driver denies fault?
A denial does not automatically end your replacement. Liability investigations take time, and the hire can continue while fault is determined. Keep your photos, witness details and the police event number, and send them to the insurer. If the denial persists, escalate through an internal review and then to the Australian Financial Complaints Authority.
Can I get a replacement if I was partly at fault?
It depends on the apportionment. If you are found partly responsible, the at-fault driver's insurer may reduce what it pays towards the hire, and you could be left with a portion. Get advice early if liability is disputed, and keep the hire reasonable. Talk to a solicitor who handles motor vehicle property damage before the bill grows.
