If you have been hit on the Hume Motorway and it was not your fault, you can usually get a replacement car of a similar standard while yours is repaired or written off. The process is different from a suburban prang: speeds are higher, trucks are involved more often, and your car may be towed a long way from home.

This page explains what happens on the Hume between Liverpool and Campbelltown, why liability is often clear, where your car ends up, and how to get a replacement to Camden, Narellan, Picton or anywhere else in south-west Sydney.

Key takeaways

  • If the crash was not your fault, the at-fault driver's insurer is liable for a like-for-like replacement car while yours is off the road.
  • Truck crashes on the Hume often have clear liability, but interstate insurers can be slow, so start the replacement process early.
  • Your car may be towed to a holding yard far from home; keep the tow docket and tell the insurer where you want it repaired.
  • Replacement cars can be delivered to Camden, Narellan, Picton and surrounding suburbs, usually within a day.
  • Credit hire lets you get a replacement car without paying upfront, with the provider recovering the cost from the insurer.

The Hume between Liverpool and Campbelltown: where it goes wrong

The Hume Motorway is the M31. It starts as the South Western Motorway at Prestons and runs south-west through Glenfield, Ingleburn, Minto, Campbelltown and on to Menangle, Douglas Park and Picton Road. Most Sydney drivers know the first 40 kilometres as a fast, multi-lane commuter road; beyond Campbelltown it becomes a rural highway with fewer exits and longer gaps between services.

Crashes cluster in predictable spots. Northbound, the climb out of the Menangle bridge catches heavy vehicles that are slow to build speed. Southbound, the descent towards Picton Road is where cars and trucks mix at 110 km/h. The M5 interchange at Prestons, the Brooks Road on-ramp at Ingleburn and the Narellan Road exit at Campbelltown are all common sites for rear-end and lane-change collisions.

Time of day matters. Between 6am and 9am, the Hume carries commuters from Camden, Narellan and Harrington Park towards the city. Between 2pm and 6pm, the same traffic returns. In between, it is a freight route. If you are hit at 7:30am on a Tuesday, you are probably in a queue of cars; if you are hit at 1pm, you may be the only car for a kilometre and the other vehicle is more likely to be a truck.

What goes wrong is usually simple: someone fails to notice traffic slowing, or a truck changes lanes without seeing a car in a blind spot. The result is a high-speed impact, a long skid, and a car that is not drivable. That is when the questions start.

Truck involvement and why liability is usually clear

When a truck is involved, fault is often easier to establish than in a car-versus-car dispute. Trucks have strict lane discipline, longer stopping distances and, in most cases, telematics and dashcams. If a B-double runs into the back of you on the Hume near the Menangle interchange, the physical evidence usually tells the story.

That does not mean the insurer will admit it immediately. Truck insurers are commercial operations. They will want the police report, the tow report, photographs and a statement. But the liability itself is rarely complicated. A rear-end collision is presumed to be the following driver's fault unless there is a good reason otherwise.

If the truck is from interstate, the claim may be handled by a different insurer or a different office. That can slow things down. It does not change your right to a replacement car if you were not at fault. Under NSW law, the at-fault driver's insurer is liable for your reasonable losses, including the cost of a replacement vehicle while yours is off the road. The leading case is Arsalan v Rixon [2021] NSWCA 325, which confirmed that a not-at-fault driver can recover the cost of hiring a replacement car even if they did not actually hire one.

If you are a fleet manager, the same principle applies, but the paperwork is heavier. You will need to show the vehicle was off the road, the hire was necessary and the rate was reasonable. Our business and fleet page covers that in more detail.

Long tows and where your car is taken

A crash at 100 km/h on the Hume does not leave you with a car you can drive to your local panel shop. The tow truck that responds is usually the one on the police rotation or the one your insurer sends, and it will take your car to the nearest safe holding yard, not to the repairer of your choice.

From the Hume between Liverpool and Campbelltown, that often means a yard in Ingleburn, Minto or Campbelltown. From Menangle or Picton Road, it may be a yard in Camden or even further south. If the crash is near the M5 interchange, the car might go to Prestons or Liverpool. The tow distance can be 30 to 60 kilometres, and the storage yard may be nowhere near your home or your preferred repairer.

This creates two problems. First, you may not know where your car is for a day or two. Second, the insurer's assessor will go to the yard, not to your driveway. If you want the car repaired at a specific shop, you need to tell the insurer early and be prepared to arrange a second tow at your own cost or through your policy.

Keep the tow docket. It has the yard name, address and contact number. Without it, you are chasing your car through the insurer's call centre, which is slower than calling the yard directly.

Getting a replacement car to Camden, Narellan or Picton

South-west Sydney is not the CBD. If your car is off the road and you live in Camden, Narellan, Harrington Park, Oran Park or Picton, you need a replacement that can handle the same driving you do: the Camden Valley Way, the Northern Road, the M5 and the Hume. A small hatchback may not be a like-for-like replacement for a prestige SUV or a work ute.

Like-for-like does not mean identical. It means a vehicle of similar size, type and standard. If you were driving a BMW X5, a replacement should be a comparable SUV. If you were in a Ranger or HiLux, you need a ute. If you were in a Silverado, you need something with similar capability.

Delivery is available across the region. A replacement car can be brought to your home, your workplace or the repairer, and the damaged car can be collected at the same time if that helps. The rate, the bond and any fees are shown on the car's page before you pay. Bookings are fulfilled by Drive Tribe (drivetribe.com.au), and this site is part of that group.

What to do if the crash is near the Menangle interchange

The Menangle interchange is where the Hume crosses the Nepean River and the rail line. It is a rural setting with limited shoulders, no street lighting and long distances between exits. If you crash there, the first priority is safety: get out of the traffic lanes, behind the barrier if you can, and call 000 if anyone is injured.

Police will attend if the road is blocked or someone is hurt. If it is a minor collision and the cars are drivable, you may be directed to exchange details and move on. If not, the highway patrol will arrange a tow. The nearest towns are Menangle, Douglas Park and Picton. The nearest hospital is Camden Hospital or Campbelltown Hospital, depending on the direction.

Once you are safe, do these things in order:

  1. Photograph the scene, the damage, the other vehicle's plates and the truck's company name if there is one.
  2. Get the other driver's name, licence number, insurer and claim number if they have it.
  3. Note the time, the weather and the traffic conditions.
  4. Ask the tow operator where the car is going and write it down.
  5. Call your insurer and tell them it was not your fault.
  6. Call a replacement car provider and ask what they can deliver to your address.

Do not admit fault, even if you think you might have contributed. Liability is for insurers to sort out. Your job is to record what happened.

Insurer assessment when the car is in a holding yard

When your car is in a holding yard, the insurer's assessor will inspect it there. You may not be present. The assessor will decide whether it is repairable or a write-off, and if repairable, they will authorise a repairer. That repairer may be one of the insurer's network shops, not the one you would have chosen.

You have the right to nominate a repairer, but if the car is in a yard 50 kilometres from your preferred shop, the insurer may refuse to pay the extra tow. In practice, many prestige owners choose to have the car moved to a specialist repairer at their own cost, because the difference in workmanship matters. If you are in that position, get a quote for the tow and decide whether it is worth it.

The assessment can take a few days. In the meantime, your replacement car should already be organised. You do not need to wait for the assessment to book a replacement, as long as you have a claim number or a police report and the other driver's details. The replacement is part of your loss, and it accrues from the day of the crash, not the day the insurer admits fault.

If the insurer delays, keep a record of every call, email and text. Our dealing with insurers page has a template for a letter of demand.

Repair versus write-off at highway speeds

Highway crashes cause more damage than suburban ones. At 100 km/h, the energy involved is roughly four times that of a 50 km/h crash. That means more structural damage, more airbag deployment, more sensors and more electronics to replace. A car that looks repairable may be a statutory write-off once the assessor adds up the parts and labour.

In NSW, a write-off is either repairable or statutory. A repairable write-off can be repaired and re-registered, but it must pass a heavy vehicle inspection and the written-off vehicle register. A statutory write-off cannot be re-registered; it is parted out. The insurer will pay you the market value or the agreed value, less any excess, and take the car.

If your car is written off, your replacement car claim does not end. You are still entitled to be put back in the position you were in before the crash, which may include a replacement vehicle for a reasonable period while you find a new car. That period is usually two to four weeks, depending on the market.

For more on this, see our repairs and write-offs page and the Drive Tribe guide to written-off not at fault.

Keeping a work ute on the road after a Hume crash

If your ute is your livelihood, a Hume crash is a business problem, not just a transport problem. A tradie from Camden with a HiLux and a tray full of tools cannot wait a week for a replacement. A fleet manager with five Rangers on the road needs to know which one is off the road and when it will be back.

The good news is that utes are usually available as replacement vehicles. The same like-for-like principle applies: if you were driving a 4x4 dual-cab, you get a 4x4 dual-cab. It may not be the same brand or the same year, but it needs to do the same job. Towing capacity matters if you are pulling a trailer. Payload matters if you are carrying tools. A city hatchback is not a replacement for a work ute.

For fleet operators, the paperwork is the main difference. You will need to show:

  • The vehicle was registered and insured for business use.
  • The driver was not at fault.
  • The vehicle was off the road for a specific period.
  • The replacement was necessary for the business to keep operating.
  • The rate was reasonable for the type of vehicle.

If you are a fleet manager, start with our business and fleet page and the Drive Tribe fleet replacement page. If you are a smash repairer or solicitor looking for a referral partner, see partners and referrals.

The first 24 hours after a Hume crash

The first day is when the important decisions are made. If you leave them until the insurer calls, you lose time. Here is a checklist for the first 24 hours after a not-at-fault crash on the Hume.

  1. Make sure everyone is safe. Call 000 if anyone is injured.
  2. Call the police if the road is blocked, someone is injured, or the other driver fails to stop. For a minor collision, you may be told to exchange details and move on.
  3. Photograph everything: the position of the cars, the damage, the road, the weather, the other driver's licence and rego.
  4. Get the other driver's name, address, phone, licence number, insurer and claim number.
  5. Find out where your car is being towed. Write down the yard name and address.
  6. Call your insurer and report the crash. Tell them it was not your fault.
  7. Call a replacement car provider. Ask what they can deliver to your suburb and when.
  8. Keep a folder, physical or digital, with every document, photo and message.

If you are in the Camden, Narellan or Picton area, delivery can usually be arranged the same day or the next morning. If you are further south, it may take a little longer. The key is to call early.

For a broader checklist, see our first 24 hours guide and what to do after a not-at-fault accident.

How credit hire works when the insurer is slow

Credit hire is the arrangement where a replacement car provider supplies you with a vehicle on credit, and the at-fault driver's insurer pays the bill at the end. You do not pay upfront. You sign an agreement that says you will co-operate with the provider and the insurer, and the provider takes on the risk of recovering the cost.

It is not a loan. It is a hire agreement, and the rate is set at a reasonable market rate for the type of vehicle. The insurer may dispute the rate or the duration, but under Arsalan v Rixon, the not-at-fault driver is entitled to recover the reasonable cost of a replacement vehicle, whether or not they actually hired one.

Credit hire is most useful when the at-fault insurer is slow to admit liability, which is common with interstate truck insurers. You get a car immediately, and the provider deals with the recovery. If the insurer refuses to pay, the provider may pursue the at-fault driver directly, but that is their problem, not yours.

For a full explanation, read how credit hire works and what is credit hire explained.

Questions people ask

Can I get a replacement ute after a Hume Motorway crash?
Yes, if you were not at fault and you were driving a ute, you can usually get a replacement ute. Like-for-like means a similar vehicle, so a 4x4 dual-cab is replaced with a 4x4 dual-cab. It may not be the same brand or year, but it will have similar capability. Delivery is available to south-west Sydney suburbs. The rate, bond and fees are shown on the car's page before you pay.
What happens if my car is towed to another suburb?
Your car is often taken to the nearest holding yard, which may be in Ingleburn, Minto, Campbelltown or further south. You can ask for it to be moved to your preferred repairer, but the insurer may not pay the extra tow. Keep the tow docket and tell the insurer where you want the car repaired as soon as possible. The replacement car can be delivered to you regardless of where your car is.
Is a truck driver's insurer liable for my replacement car?
If the truck driver was at fault, their insurer is liable for your reasonable losses, including the cost of a replacement car. This applies even if the truck is from interstate. The insurer may take longer to admit liability, but your entitlement does not depend on a quick admission. You can use credit hire to get a car immediately while the claim is sorted out.
How long can I keep the replacement car?
You can keep it for a reasonable period, which is usually the time it takes to repair your car or, if it is written off, the time it takes to find a replacement. That is often two to four weeks for a write-off, and longer for a repair. The insurer may dispute the duration, but the test is reasonableness. Keep records of the repair timeline and any delays.
Do I need to pay anything upfront for a replacement car?
With credit hire, you do not pay upfront. You sign an agreement and the provider recovers the cost from the at-fault insurer. There may be a bond, which is refundable, and a small surcharge if you pay by card. Bank transfer and cash on the rental do not carry the surcharge. The rate, bond and any fees are shown on the car's page before payment.
What if the other driver does not stop?
If the other driver fails to stop, call the police immediately. In NSW, failing to stop after a crash is an offence. If you cannot identify the other driver, you may need to claim through your own insurer or the Nominal Defendant. A replacement car may still be available, but the process is different. Get legal advice if you are unsure.
