Not at fault in the Hills District: Castle Hill to Kellyville

Genesis GV80 photo 4
Genesis GV80 photo 4

If another driver hits you on Windsor Road or Old Northern Road and you are not at fault, you are entitled to keep driving something comparable while your car is repaired, and in most cases the at-fault insurer pays for it. The Hills District adds its own wrinkles: long arterials with no safe place to stop, school zones that empty in ten minutes, and new estates where the nearest panel shop is a twenty-minute tow.

This page covers what to do at the scene, how towing works from a clearway or school zone, how a replacement car reaches your driveway in Castle Hill or Kellyville, and what the at-fault insurer actually owes you under NSW law.

Key takeaways

  • If you are not at fault in the Hills District, the at-fault insurer is liable for a reasonably comparable replacement car while yours is repaired.
  • Windsor Road, Old Northern Road and Showground Road produce most local not-at-fault crashes, so photograph the scene before anything moves.
  • You choose the tow and the repairer, even from a clearway or school zone, and you are not bound to the insurer's preferred shop.
  • Replacement cars are delivered to homes and workplaces across Castle Hill, Kellyville, Baulkham Hills and Rouse Hill.
  • Prestige repairs typically run one to eight weeks depending on parts, and you can keep the replacement car for the whole period.

The Hills' crash hotspots: Windsor Road, Old Northern Road and Showground Road

Most not-at-fault prangs in the Hills happen in a handful of predictable places, and knowing them helps you describe the crash accurately to your insurer and to a tow operator.

  • Windsor Road between Baulkham Hills and Rouse Hill. Three lanes each way, 70 to 80 km/h limits, and heavy merging near the Norwest Boulevard and Samantha Riley Drive lights. Rear-end and lane-change collisions dominate.
  • Old Northern Road through Castle Hill and Dural. Narrower, older, with service roads and driveways opening onto the carriageway. T-bone crashes at the Showground Road intersection are common on school afternoons.
  • Showground Road near Castle Hill Showground and the Castle Towers precinct. Car park exits, buses and drop-off traffic create low-speed but frequent contact.
  • Norwest Boulevard and Lexington Drive around Norwest Business Park. Roundabouts and car park entries, worst at 8.30am and 5.30pm.
  • Terry Road and Bella Vista Drive in the new estates, where give-way rules at newly opened intersections still catch drivers out.

The single most useful thing you can do is photograph the scene before anything moves, including the position of both cars, the lane markings and any give-way or stop sign. Insurers decide fault on evidence, and in the Hills the at-fault driver is often a local who will later describe the crash differently.

What to do at the scene on a busy arterial

On Windsor Road at 5pm you cannot stand in lane two having a conversation. Work through this in order.

  1. Check nobody is hurt. If anyone is injured, call 000 first. Ambulance and police attendance creates an official record, which is worth more than any photo.
  2. If the cars are drivable and there is a side street, car park or service road within a hundred metres, move there. Stopping on a live arterial is how a minor crash becomes a multi-car one.
  3. If the cars cannot move, hazard lights on, get everyone behind the barrier or well off the shoulder, and call police. Do not stand between the vehicles.
  4. Photograph everything: both number plates, both cars from four angles, the road layout, skid marks, debris, and the other driver's licence and CTP green slip if they will show you.
  5. Exchange names, addresses, phone numbers, licence numbers and insurer details. Note the make, model and colour of the other car.
  6. Ask any bystander who saw it happen for their number. In the Hills, shop staff and tradies on a smoko break are often the best witnesses.

Do not admit fault, do not apologise, and do not agree to settle privately on the spot. Even a polite "sorry mate" can be quoted back to you later. If the other driver is aggressive or refuses to exchange details, call police and stay in your car with the doors locked.

Towing from a clearway or school zone

A tow from a Windsor Road clearway or a Castle Hill school zone has two problems: it is time-critical and it is legally sensitive.

In a school zone during drop-off or pick-up, you are usually inside a no-stopping area. RMS and council rangers can and do move vehicles that block the zone, and a tow truck that arrives without your authority can leave you with a bill and a car you did not choose. The rule is simple: you choose the tow, not the driver who happened to stop first.

What to do:

  • Call your own tow provider, or the one your repairer or replacement-car company recommends. Unsolicited tow trucks that appear within two minutes of a crash are usually chasing the repair work, not your interests.
  • Confirm in writing, by text, where the car is going and the tow cost. Keep the message.
  • If police attend, they may direct a tow for safety. That is fine; note the company name and the destination.
  • Photograph the car before it is loaded, including the odometer and any damage that was not there before.

If your car is undriveable, the tow destination matters more than the tow itself. Send it to a repairer you have chosen, not to a holding yard in an industrial estate in Blacktown or Seven Hills that you have never heard of and cannot easily visit.

Choosing a repairer in Castle Hill, Baulkham Hills or Kellyville

You are not obliged to use the repairer your insurer suggests. In NSW you can choose your own, provided the repair is done to a proper standard and the cost is reasonable. For a prestige or performance car, that choice matters.

What to look for in the Hills:

  • Manufacturer-approved or specialist prestige capability. Aluminium bodies, adaptive cruise radar, cameras behind the windscreen and complex paint finishes all need the right equipment and training.
  • A workshop you can reach. Castle Hill, Baulkham Hills and Bella Vista have good options; a shop in Blacktown or Girraween adds a forty-minute round trip to every update.
  • Willingness to deal directly with the at-fault insurer and to provide progress updates without you chasing.
  • Clear communication about parts. European marques can wait weeks on a bumper or headlight from overseas, and you should know that on day one, not day twenty.

Ask the repairer two questions before you commit: how long is the current wait for a booking, and do they handle the insurer directly or will you be the middleman. If you are unsure where to start, our guide to how long prestige car repairs take in Sydney sets out realistic timelines, and repairs and write-offs covers what happens if the damage is worse than it looks.

How a replacement car reaches you in the Hills

This is the part people worry about unnecessarily. You do not need to get to Mascot or Parramatta to collect a replacement car. Delivery is available, and in the Hills it is the normal way it happens.

A replacement car can be brought to your home, your workplace, or the repairer, at a time that suits. In practice that means:

  • Castle Hill, Baulkham Hills and Bella Vista: delivery to a driveway or to Norwest Business Park during the working day.
  • Kellyville, Rouse Hill and Stanhope Gardens: delivery to home addresses in the new estates, including streets off Samantha Riley Drive and Windsor Road.
  • Dural, Glenorie and Kenthurst: semi-rural addresses, so give a clear description of the driveway and any gate.

Bring your licence, and have your claim reference and the other driver's details ready. The handover takes about fifteen minutes. Bookings are fulfilled by Drive Tribe (drivetribe.com.au), and this site is part of that group, so the car you are handed is the car you booked.

AccidentClaim lodgedCar deliveredYour car repairedHire recovered from the at-fault insurer

What the at-fault insurer owes you

Under NSW law, a driver who is not at fault can recover the reasonable costs that flow from the other driver's negligence. The High Court confirmed in Arsalan v Rixon that this includes the cost of hiring a replacement vehicle while your own car is off the road, even where you could have gone without one. The test is reasonableness, not necessity.

In practice, the at-fault insurer owes you:

  • A replacement car that is reasonably comparable to yours, for a reasonable period. That is what like-for-like means, and it is why a prestige or performance car is replaced with something similar rather than a base hatch.
  • Repair costs, paid to your chosen repairer.
  • Tow and storage costs that were reasonably incurred.
  • In some cases, other losses such as excess travel or a written-off vehicle's market value.

What you never pay: the hire itself, where the claim is handled properly through credit hire. You do not pay the daily rate, and you do not pay the bond as a fee; the bond equals the excess you choose, and it is refunded. Paying by card carries a small surcharge, while bank transfer and cash on the rental do not. Every rate, bond and fee is shown on the car's page before payment.

Read more on the at-fault insurer's obligations in NSW and the reasonable hire car test.

How long repairs take for prestige cars in the Hills

Two variables decide how long you keep the replacement car: the repair itself and the insurer's approval process.

DamageTypical time off the road
Bumper, guard or door skin, parts in stock1 to 2 weeks
Panel plus paint blending across two panels2 to 4 weeks
Structural or suspension damage, parts from overseas4 to 8 weeks
Airbag deployment or chassis repair8 weeks and up, sometimes a write-off

Add time for the insurer's assessor to inspect, which in the Hills can take several days at peak periods. If parts have to come from Germany or Japan, the wait is real and nobody can shortcut it.

The practical move is to keep the replacement car for the whole repair period, not just the first fortnight. You are entitled to a comparable car until yours is back, provided the overall claim is reasonable. If the insurer suggests cutting the hire short while your car is still in the shop, that is a dispute, and our page on insurer disputes over hire car claims explains how to handle it.

What to do if the other driver is uninsured

Every registered vehicle in NSW carries a compulsory third party green slip, which covers injuries, not property damage. If the other driver has let their registration or CTP lapse, or is driving unregistered, the property damage path changes.

Your options:

  1. Claim on your own comprehensive policy. Your insurer repairs your car, you pay your excess, and your insurer may pursue the other driver. You can usually recover the excess later if fault is established. See claiming on your own insurer when not at fault.
  2. Claim directly against the other driver. This is a civil debt. It works when they have assets and admit fault; it is slow when they do not.
  3. Check whether the vehicle was unregistered but the driver insured elsewhere, for example through a business policy.

If the other driver is uninsured but clearly at fault, a credit hire arrangement can still work, because the claim is against the driver, not their insurer. The paperwork is heavier and the recovery is less certain, so be honest about the circumstances when you enquire. If you are dealing with a write-off rather than a repair, start with written off not at fault.

The first 24 hours, and who to call

The first day sets up everything that follows. In order:

  1. Report the crash to police if anyone was injured, if a car was towed, or if the other driver failed to exchange details. You can do this at Castle Hill or Riverstone police station, or online for minor incidents.
  2. Notify your own insurer, even if you are not claiming through them. Most policies require it.
  3. Book the repair and get a written estimate or booking date.
  4. Arrange the replacement car so it is waiting when yours goes in, not three days later.
  5. Keep every receipt, text and email in one folder. Fault disputes are won on documents.

If you are a fleet manager with vehicles based around Norwest or Castle Hill, the same steps apply but the paperwork is multiplied. Our business and fleet page covers running several claims at once, and partners and referrals is where repairers, solicitors and brokers can set up a referral arrangement.

Start with the first 24 hours after a not-at-fault crash, then check availability at accident replacement car Sydney.

Questions people ask

Can I get a replacement car delivered to Castle Hill?
Yes. Delivery is available across the Hills District, including Castle Hill, Baulkham Hills, Bella Vista, Kellyville and Rouse Hill. A driver brings the car to your home, your workplace or the repairer, usually within a day or two of your booking being confirmed. Have your licence, claim reference and the other driver's details ready for the handover, which takes about fifteen minutes. Delivery to Norwest Business Park during the working day is common for people who cannot take time off.
What if I crash in a school zone in the Hills?
Move the cars out of the zone if they are drivable, because you are likely in a no-stopping area and rangers can clear the road. If they cannot move, hazard lights on, get everyone onto the footpath and call police. Photograph the position of both cars and any signage before a tow arrives, and insist on choosing your own tow operator. Do not accept a tow from a truck that arrives uninvited; those operators are usually chasing repair work rather than looking after your interests.
How long can I keep a replacement car while my car is repaired?
For the reasonable repair period, which is set by how long the repair genuinely takes, not by an arbitrary cap. A bumper repair might be one to two weeks; structural damage with overseas parts can run four to eight weeks. You are entitled to a comparable car until yours is back on the road. If an insurer tries to cut the hire short while your car is still in the workshop, that is a dispute worth pushing back on with documentation.
Do I have to use the repairer my insurer recommends?
No. In NSW you can choose your own repairer, provided the work is done properly and the cost is reasonable. For a prestige or performance car, choose a workshop with the right approvals, equipment and paint capability for your marque. Ask how long the current booking wait is and whether they deal with the insurer directly. A repairer close to Castle Hill or Baulkham Hills saves you repeated trips for updates and pickup.
What if the other driver is uninsured or unregistered?
Their CTP green slip covers injuries, not property damage, so you cannot claim repair costs from it. Your practical options are claiming on your own comprehensive policy and recovering the excess later, pursuing the driver directly as a civil debt, or a credit hire arrangement against the driver personally. The last one is possible but carries more recovery risk, so be upfront about the circumstances when you enquire.
Will using a replacement car affect my own insurance or no-claim bonus?
A properly run not-at-fault claim should not affect your no-claim bonus, because fault sits with the other driver. If you claim on your own policy first, your insurer may still record the incident, so tell them clearly that you were not at fault and provide the other driver's details and any police reference. Keep copies of everything. If your insurer treats it as an at-fault claim, escalate it in writing rather than accepting the decision.
