If you are 21 and someone runs up the back of your Golf R on Parramatta Road at Artarmon, the at-fault insurer owes you a replacement car that matches what you lost, and your age does not change that. What changes is which cars you can actually be put in, who is allowed to drive them, and how quickly they can reach you.

This page explains how the minimum driver age works on prestige and performance replacements, what to do if the insurer tells you that you are too young, how to add a parent as a second driver, and what you are signing when you accept the car. It is general information, not legal advice.

Key takeaways

  • Your age does not remove the at-fault insurer's duty to provide a comparable replacement car after a not-at-fault crash in NSW.
  • Most cars on the fleet have a minimum driver age of 20, but some performance and prestige models are set at 25 or 30.
  • A full NSW licence is the baseline, and any undisclosed suspension or conviction can void the hire agreement.
  • Adding a parent or partner as a second driver is usually possible, provided they meet the car's minimum age.
  • If the insurer refuses on age grounds, ask for the refusal in writing, source a comparable car yourself and keep every record.

Why the at-fault insurer owes you a car regardless of your age

The duty to put you back behind the wheel comes from the at-fault driver's liability, not from your birth date. In NSW the leading case is Arsalan v Rixon, where the Court of Appeal confirmed that a not-at-fault motorist can recover the reasonable cost of a replacement vehicle while their own car is off the road, including the cost of hiring something of comparable quality.

That principle applies to a 21-year-old in a Golf R the same way it applies to a 55-year-old in an S-Class. The insurer is compensating you for the loss of use of your car, and if your car was a performance hatch, the loss is the use of a performance hatch, not a base Corolla from a depot on the other side of Sydney.

What age does affect is the practical side of the hire. Hire companies set minimum driver ages for insurance and risk reasons, and some prestige models carry a higher minimum than others. That is a fleet rule, not a legal bar, and it is why the answer is usually a specific car rather than a flat no.

If you want the statutory background in plain English, our not-at-fault explained page walks through the Motor Accidents Injuries Act framework and how it sits alongside the common law duty to compensate.

The short version for a young driver: you have a claim, and the argument is about which car, not whether you get one.

The minimum driver age on most cars and why some are 25 or 30

On most of the prestige and performance fleet, the minimum driver age is 20. On some cars it is 25 or 30, and that is usually because of the car's power, its value, or the way the insurer behind the fleet prices risk on a vehicle of that type.

Here is how the three cars most commonly used for young-driver replacements sit:

CarMinimum driver ageBaseDelivery
Mercedes-AMG C63 S20ParramattaAvailable
Audi RS 3 Sportback25MerrylandsAvailable
Tesla Model Y RWD25MerrylandsAvailable

So a 21-year-old whose own car was a C63 can be placed in a C63, because that car's minimum is 20. A 21-year-old whose car was an RS 3 is a harder match on age, but the answer is usually to look at what else in the same tier is available at a minimum of 20, and to document why the substitute is equivalent in performance and prestige.

This is where the equivalence argument matters. If your car was a 294 kW all-wheel-drive hatch and the insurer offers a base SUV, that is not like-for-like. If the closest available car at your age is a rear-drive performance sedan with comparable power and a higher original list price, that is a reasonable substitute and you should say so in writing.

Our how equivalence is assessed page sets out the factors assessors actually look at. If you want to see what is bookable at your age right now, the fleet is listed at accident replacement car Sydney.

Do not assume the highest minimum applies to you. Ask the question car by car, because the numbers genuinely differ across the fleet.

What to do if you are 21 and your car was a performance model

Start by getting the other driver's details and the claim reference, then photograph your car from four corners plus the damage close up. Do this before the tow truck takes it, ideally within the first hour, because the insurer will ask for images and you want them taken in daylight if you can manage it.

Then call the at-fault insurer and tell them you need a replacement vehicle of comparable type. Have your licence number, your rego, the claim number and the make, model and year of your car ready. If your car was a performance model, say so plainly: "My car is a 2022 Audi RS 3 Sportback, all-wheel drive, 294 kW. I need a comparable replacement."

Expect one of three responses:

  1. They arrange a car through their own supplier, which is often a base model from a general fleet.
  2. They tell you to hire yourself and claim the cost back, which is credit hire.
  3. They push back and say you are too young or that the car is not covered.

For response two, read how credit hire works before you sign anything, because the terms matter. For response three, go to the section below on what to say when the insurer refuses on age grounds.

If you are in the middle of this right now and need a car moving today, the practical step is to check availability and let the hire company deal with the insurer directly. The booking and delivery process for not-at-fault replacements is set out at not at fault accident replacement.

One thing to avoid: do not accept a cash settlement for loss of use before you have priced what a comparable car actually costs to hire for the expected repair period. Once you sign, the argument is over.

Licence, driving history and the insurer's questions

A full NSW licence is the baseline. If you are on your Ps, some fleets will still place you, but expect more questions, and expect the car offered to be at the lower end of the tier you are claiming. Learner permits are generally not accepted for self-drive prestige hires.

The insurer or the hire company will typically ask:

  • Your licence number, class and expiry date.
  • How long you have held a full licence.
  • Whether you have had any at-fault claims or licence suspensions in the last three to five years.
  • Whether you have any driving convictions, including low-range PCA.
  • Whether you intend to carry passengers for hire or reward, which is almost always excluded.

Answer honestly. If a suspension from two years ago comes out later, the hire agreement can be voided and you can be left holding the cost. That is the single most common way a young driver's replacement claim collapses, and it is entirely avoidable.

If your history is clean, say so and move on. If it is not clean, tell the hire company up front so they can place you in a car that will actually be approved, rather than having the car collected from your driveway a day later.

Also check the licence itself. If it expired last month and you have not renewed it, sort that out before you try to collect a car, because no fleet can release a vehicle to an expired licence.

For the broader checklist of what to gather in the first day, see the first 24 hours.

Adding a parent or partner as a second driver

You can usually add a second driver to the agreement, and for a young driver this is often the difference between a car you can use and a car that sits in the driveway while you are at work. A parent, a partner or a sibling with a full licence can be listed, subject to the same age minimum as the car itself.

The mechanics are simple. When you book, provide the second driver's full name, licence number, date of birth and licence class. They will need to be present, or at least available by phone, when the car is delivered, so the hire company can verify the licence against the physical card.

A few practical points:

  • The second driver must meet the car's minimum age. Adding a 22-year-old to a car with a minimum of 25 will not work.
  • Only listed drivers are covered. If your mate drives it to the shops and hits a pillar at Broadway Shopping Centre, you are on your own.
  • Adding a driver does not change who is liable under the credit hire agreement. If you signed it, you are the one on the hook.
  • If the second driver has a worse history than you, that can affect approval. Sometimes it is better to leave them off.

For a family where the car is shared, adding a parent is sensible. For a 21-year-old with a clean record and no need to share, it is optional.

If your circumstances are unusual, for example a parent who lives interstate or a partner on an overseas licence, raise it before the booking is confirmed rather than at the kerb.

Delivery to uni, work or the repairer

Delivery is available on the cars listed here, and for a young driver in Sydney it is usually the difference between a smooth week and a lost one. Common delivery points we see:

  • University campuses, particularly UNSW around Kensington and Sydney Uni around Camperdown, where parking is tight and a car arriving at a set time matters.
  • Workplaces in the CBD, North Sydney, Macquarie Park and Parramatta, with delivery to a loading zone or a nearby street rather than the building's basement.
  • Smash repairers, so the replacement is handed over at the same time your car is dropped off. This is the cleanest option because both cars are in one place and the paperwork is done in one sitting.
  • Home addresses across the inner west, the Hills, the Shire and the northern beaches.

Timing is the thing to get right. A delivery to the CBD at 8am on a weekday means fighting George Street traffic and finding a legal spot; a delivery to the same address at 10am is straightforward. If you can be flexible by an hour, say so.

For a repairer handover, give the hire company the repairer's name, address and the name of the person who will receive the car. Most Sydney prestige repairers are used to this and will sign the condition report on your behalf if you have authorised it.

If you are outside the metro area, ask about delivery before you assume it is not possible. Our replacement by area page covers the broader Sydney and NSW picture, and how long prestige repairs take helps you estimate how long you will need the car for.

What you sign and what it commits you to

When you accept a replacement under credit hire, you are signing an agreement where the hire company provides the car now and recovers the cost from the at-fault insurer later. You are the hirer, and that has consequences.

Read these parts before you sign:

  • The hire period and the daily rate basis. You are not usually given a dollar figure at signing, but you should understand how the period is defined.
  • What happens if the insurer refuses to pay. Some agreements leave you liable; others are structured so the hire company carries the recovery risk. Know which one you are signing.
  • The condition report. Walk the car, photograph every panel, and note existing damage. A scratch on the rear bumper that you did not record can become your problem.
  • The fuel and cleaning terms. Return it with the same fuel level and reasonably clean, or expect a charge.

Bookings are fulfilled by Drive Tribe (drivetribe.com.au), the trading name of Australian Business Holdings Pty Ltd, and this site is part of that group.

If you are not comfortable with the recovery risk sitting with you, ask whether the agreement can be structured differently, and get the answer in writing. If the numbers are large enough to worry about, talk to your solicitor before you sign, not after.

For the payment side, including how the bond works and what the surcharge situation is, see cost and payment.

If the insurer says you are too young to hire

This is the most common pushback, and it is usually a negotiating position rather than a rule. The insurer does not get to decide what you are entitled to based on your age; it is liable for the reasonable cost of a comparable replacement, and age is only relevant to the extent it genuinely limits what can be supplied.

What to do, in order:

  1. Ask them to put the refusal in writing, with the reason. "We do not hire to under-25s" is not a reason, it is a policy of one supplier.
  2. Point out that the fleet has cars with a minimum driver age of 20, and ask them to source a comparable vehicle from a supplier that will place you.
  3. If they still refuse, arrange the replacement yourself and keep every invoice and the hire agreement. You are mitigating your loss, which is what the law expects you to do.
  4. If they reject the claim for the hire cost, escalate. The dispute process is set out at insurer disputes.

What not to do: do not go without a car for six weeks and then claim a lump sum. Loss of use is much harder to recover after the fact, and the insurer will argue you failed to mitigate.

If you are 21 with a performance car and a stubborn insurer, the practical answer is to get a car on the road and let the paperwork catch up. Availability and the booking path are at credit hire vs paying yourself, and you can start a booking at drivetribe.com.au.

Choosing the right replacement when you are under 25

The car you get should match the car you lost in the ways that matter: performance, size, prestige and drivetrain. For a young driver, the constraint is the age minimum, so the skill is finding the closest match that you are actually allowed to drive.

If your car was a hot hatch or a performance sedan, look at the performance tier first and check the minimum age on each car. If your car was a prestige SUV, look at the lifestyle and SUV tiers. If your car was electric, the replacement should be electric, because charging and running costs are part of the loss.

Our pages on performance car equivalence, electric prestige equivalence and replacement by car type explain how to make the argument in each case.

If your exact model is not available at your age, read what happens when your exact model is unavailable. The short answer is that equivalence, not identity, is the test.

Questions people ask

Can I get a replacement car if I am under 25?
Yes. The at-fault insurer's liability does not depend on your age, and the leading NSW authority, Arsalan v Rixon, confirms that a not-at-fault driver can recover the reasonable cost of a comparable replacement. The practical limit is the minimum driver age set by the hire fleet, which is 20 on most cars and 25 or 30 on some performance and prestige models. If your own car was one of the higher-minimum models, the answer is usually a comparable car at a lower minimum rather than no car at all.
Does my age affect what car I can be given?
It can affect which specific cars are available to you, because each car has its own minimum driver age. It should not affect the standard of car you are entitled to. If your car was a performance model and you are 21, you are entitled to a comparable performance replacement, and the argument is about which car on the fleet meets that standard at your age. Do not accept a base model simply because it is the easiest car for the insurer to arrange.
Can my mum or dad drive the replacement car?
Usually yes, if they are added as a second driver and they meet the car's minimum age. You will need their full name, licence number, date of birth and licence class at the time of booking, and they will need to be available when the car is delivered so the licence can be verified. Only listed drivers are covered, so if someone drives the car without being on the agreement, the cover does not apply.
What if the insurer says I am too young to hire?
Ask them to put the refusal in writing with the specific reason. A blanket under-25 policy from one supplier is not a legal bar, and there are cars on the fleet with a minimum driver age of 20. If they still refuse, arrange a comparable replacement yourself, keep the hire agreement and invoices, and claim the cost. You have a duty to mitigate your loss, so going without a car for weeks weakens your position rather than strengthening it.
Do I need a full licence or can I be on my Ps?
A full NSW licence is the baseline for most prestige and performance replacements, and some fleets will consider provisional licence holders on a case-by-case basis with a car at the lower end of the tier. Learner permits are generally not accepted for self-drive hires. If your licence is expired, renew it before you try to collect a car, because no fleet can release a vehicle against an expired licence.
How long can I keep the replacement car?
For as long as your own car is genuinely off the road for repairs, plus a reasonable period for the repairer to source parts and complete the work. Prestige repairs in Sydney often take longer than a standard repair because parts come from overseas. Keep the hire company and the insurer updated with the repairer's estimated completion date, and do not return the car early just because the insurer pressures you to.
