If you were hit on Military Road or the Spit Bridge and it was not your fault, you can keep driving something equivalent to your own car while yours is repaired - and the at-fault driver's insurer normally picks up the reasonable cost. This page explains how that works for Mosman, Cremorne, Neutral Bay and Seaforth drivers, from the first ten minutes on the bridge to the day you hand the replacement back.

Bookings are fulfilled by Drive Tribe (drivetribe.com.au), and this site is part of that group.

Key takeaways

  • If you were not at fault, you can keep driving an equivalent car while yours is repaired, and the at-fault insurer normally covers the reasonable cost.
  • Get off the Spit Bridge before exchanging details; photograph licences, rego and damage, and never admit fault at the scene.
  • Like-for-like means equivalent size, class, drivetrain and equipment, not just any hire car.
  • If the other driver blames you, your photos, dashcam and witness statements do the arguing.
  • You can keep the replacement while your car is genuinely off the road, then hand it back promptly.

Why the Spit and Military Road produce so many rear-enders

The Spit Bridge opens roughly 3,000 times a year, and every opening stacks traffic back along Spit Road through Seaforth and down Military Road past Cremorne Junction. That stop-start queue is the perfect rear-end machine: drivers crest the bridge approach at 60 km/h, the queue is stationary over the rise, and the last two cars in the line take the hit.

Military Road adds its own hazards. Between the Cremorne Junction lights and the Neutral Bay shops you have bus stops, loading zones, angled parking and pedestrians crossing mid-block. Add a 40 km/h school zone at Mosman Prep and Middle Harbour Public in the morning, and the closing speeds change every 200 metres.

The result is a predictable pattern of low-speed, high-frequency collisions: bumper, boot floor, radar and reversing sensors, sometimes the boot lid and rear quarter. On a prestige car those panels are aluminium or high-strength steel, and the repair is rarely a same-week job.

If you are reading this from the side of the road, go straight to our first 24 hours guide. If you are reading it later, the sections below cover the whole claim.

What to do immediately after a crash on the bridge

The Spit Bridge is a live traffic environment. If the cars are driveable, get them off the bridge and into the first safe place - the Spit West Reserve car park on the Mosman side, the BP at Spit Junction, or the side street behind the Seaforth shops. Do not stand between the cars on the bridge deck.

Then, in order:

  1. Check for injuries and call 000 if anyone is hurt.
  2. Call the police if the road is blocked, if anyone is injured, or if the other driver leaves. For a minor prang with all details exchanged, a police report is not always required, but an event number helps later.
  3. Photograph everything: both cars from four angles, the position of the vehicles, the road, the number plates, the other driver's licence and rego, and any dashcam stills.
  4. Note the time, the weather, the traffic direction and the lane.
  5. Ask the other driver to say on camera that they were at fault. Many will, and it ends arguments later.

Do not admit fault, even politely. "Sorry" at the scene has cost people their claim. If you are not sure who was at fault, say nothing about fault and let the insurers work it out.

Age limits are set per car. Drivers under 25 can hire most cars with Young Driver Cover; the exact terms are shown before you pay.

Exchanging details when traffic is banked up behind you

You do not need a long conversation. The minimum is name, address, licence number, registration number, insurer and policy number for the other driver, plus the same for you. Take a photo of their licence and their rego sticker rather than writing it down.

If traffic is honking, swap phone numbers and photograph each other's documents, then move. You can text the rest later. If the other driver is aggressive or refuses to exchange details, note their plate and call the police non-emergency line.

Witnesses matter on the Spit. The driver behind you saw the whole thing. Ask for a name and number, and if they are in a bus or a truck, get the fleet number and the company. Bus drivers on the Military Road corridor are used to giving statements and are usually happy to help.

If there is a camera on the bridge or a nearby shop, note the location. Council and business CCTV is often overwritten within days, so ask early. Our evidence guide lists exactly what to collect.

Getting the car to a Lower North Shore or CBD repairer

You have the right to choose your own repairer. The at-fault insurer will often push you toward its preferred shop, but you are not obliged to use it. For a prestige car, that choice matters: aluminium panels, radar calibration, paint matching and factory diagnostic tools are not available everywhere.

On the Lower North Shore, owners commonly use shops around Artarmon, Crows Nest, St Leonards and Brookvale, or take the car into the CBD or Alexandria where the prestige specialists cluster. If the car is not driveable, a tow to your chosen shop is part of the claim.

Before the car goes anywhere, photograph the damage in daylight and get a written scope from your repairer. That scope is the document that proves how long you need a replacement car, and it is the single most useful thing you can hand the insurer.

If the damage is heavy, read repairs and write-offs before you agree to anything. A rear-end that looks like a bumper can hide boot floor and suspension damage.

Arranging a like-for-like replacement car the same day

Once liability is clear - or even while it is being confirmed - you can have an equivalent car delivered to Mosman, Cremorne, Neutral Bay, Seaforth or the CBD, often the same day. You book online, the rate, the bond and every fee are shown on the car's page before payment, and the car is delivered to your address or collected from a Sydney base.

Most prestige and performance cars can be booked from a single day, and the minimum driver age is 20 on most cars and 25 or 30 on some. The bond equals the excess you choose. Paying by card carries a small surcharge; bank transfer and cash on the rental do not.

How equivalence is judged for a prestige SUV or sedan

Like-for-like does not mean "any car will do". It means a replacement that is broadly equivalent in size, class, transmission, seating, performance and the features you actually use. The leading NSW case, Arsalan v Rixon, confirmed that a not-at-fault driver can recover the reasonable cost of a comparable replacement, not just a basic hire car.

In practice, insurers and courts look at:

  • Body type and seating: a seven-seat SUV replaced by a seven-seat SUV.
  • Drivetrain and performance: all-wheel drive replaced by all-wheel drive, not a front-drive hatch.
  • Transmission and fuel: automatic for automatic, diesel for diesel where it matters.
  • Badge and class: a luxury sedan replaced within the luxury tier.
  • Equipment you rely on: tow bar, roof rails, child anchor points, boot capacity for work gear.

Two examples from the fleet show how close the match can be. A Mercedes-Benz GLS is a seven-seat all-wheel-drive diesel SUV with 243 kW and 700 Nm; a BMW X7 is a seven-seat all-wheel-drive diesel SUV with 195 kW and 620 Nm. Both are legitimate replacements for a large prestige family SUV, and the choice often comes down to availability and your own preference.

Our equivalence guide goes deeper, and seven-seat prestige SUV equivalence covers the family case.

What happens if the other driver blames you

This is the most common problem on the Spit. The other driver tells their insurer you braked suddenly or changed lanes, and suddenly you are the one being chased. Do not panic and do not argue on the phone.

Your evidence does the arguing. A rear-end collision is usually the following driver's responsibility, because the law expects them to leave enough space to stop. Dashcam footage, the position of the damage, witness statements and the police event number all support that.

Send your insurer and the other insurer a short, factual timeline with the photos attached. Keep it to what happened, not what you think of the other driver. If the other insurer denies liability, our insurer disputes page sets out the escalation path, including internal review and, if needed, the Australian Financial Complaints Authority.

Meanwhile, your replacement car can continue if your claim is being handled under credit hire, because the hire is arranged on the basis that liability will be recovered. Read what not-at-fault means in NSW so you can hold your ground.

Keeping the claim moving when the insurer goes quiet

Insurers go quiet for boring reasons: assessor backlogs, a missing document, a liability query, or a repairer who has not sent the scope. The fix is a paper trail and a weekly follow-up, not a daily phone call.

Keep a single file with:

  • The police event number and the other driver's details.
  • Your photos and any dashcam clips, saved in two places.
  • The repairer's written scope and estimated repair time.
  • Every email and a short note of every call, with the date and the person's name.

Ask for the claim reference and the name of the assessor. Send one clear email each week asking for the next step and a date. If nothing moves after two weeks, ask for the complaint process. If that fails, AFCA is free and insurers take it seriously.

If your car is a total loss, the replacement car question changes - see repairs and write-offs. If you run a business and the car is on the fleet, business and fleet covers the downtime and cost side, and dealing with insurers has the templates.

How long you can keep the replacement, and when to hand it back

The general rule is that you can keep a like-for-like replacement for as long as your car is genuinely off the road being repaired, plus a short, reasonable period to hand it back. If the repair takes three weeks, you keep the car for about three weeks. If parts are delayed, the hire can be extended, provided the delay is documented by your repairer.

Two things end the hire: your car being ready, and the claim being resolved. Do not keep the car for a weekend after your car is finished, because that is the kind of detail an insurer will use to reduce the payout. If you are unsure, ask before you extend.

Questions people ask

Can I get a replacement car after a crash on the Spit Bridge?
Yes, if the crash was not your fault. A replacement car can be delivered to Mosman, Cremorne, Neutral Bay, Seaforth or the CBD, often the same day, and the cost is normally recovered from the at-fault driver's insurer. You will need the other driver's details, a police event number if one was issued, and photos of the damage. Book online and the rate, bond and any fees are shown on the car's page before you pay.
What if the other driver says the crash was my fault?
Do not argue on the phone. Send your insurer and the other insurer a short factual timeline with your photos, dashcam footage and witness details. A rear-end collision is usually the following driver's responsibility. If the other insurer denies liability, ask for its internal review, and if that fails, take it to the Australian Financial Complaints Authority, which is free.
How long can I keep a like-for-like replacement car?
For as long as your car is genuinely off the road being repaired, plus a short reasonable period to return it. If your repairer documents a parts delay, the hire can be extended. Once your car is ready, hand the replacement back promptly, because keeping it longer can reduce what the insurer pays.
Do I have to use the insurer's preferred repairer?
No. You can choose your own repairer, and for a prestige car you should, because aluminium panels, radar calibration and factory diagnostics are not available at every shop. Lower North Shore owners often use Artarmon, Crows Nest or St Leonards, or take the car into the CBD or Alexandria. Get a written scope from your repairer to support the length of the hire.
What counts as a like-for-like replacement for a prestige SUV?
A replacement of similar size, seating, drivetrain, performance and equipment. A seven-seat all-wheel-drive luxury SUV should be replaced by another seven-seat all-wheel-drive luxury SUV, not a small hatch. The leading NSW case, Arsalan v Rixon, supports recovering the reasonable cost of a comparable vehicle, so keep the match close and document why.
Who pays for the replacement car?
In a not-at-fault claim, the at-fault driver's insurer is normally responsible for the reasonable cost. Many drivers use credit hire, where the hire company is paid after the claim is settled. Before you sign, read the agreement so you understand your obligations. If liability is disputed, the hire can usually continue while the dispute is resolved.
