If a ute, van or light commercial hits your car and the crash was not your fault, you are entitled to a replacement vehicle that matches what you were driving, not a small hatchback. The other driver's commercial insurer will often handle the claim differently from a private one, but that does not reduce your entitlement.

This guide covers what to collect at the scene, how liability works when a business vehicle is involved, and how to keep a like-for-like replacement moving while your car is off the road. It is written for drivers in Sydney and across New South Wales who drive something worth replacing properly.

Key takeaways

  • A crash with a work ute or van does not reduce your right to a like-for-like replacement car.
  • Collect the business name, ABN, insurer and policy details at the scene if you can.
  • Do not admit fault or sign anything without understanding what it covers.
  • If the commercial insurer delays, credit hire can provide a car now while the claim is recovered later.
  • Delivery and collection can be arranged around work hours across Sydney.

Why commercial vehicle crashes are handled differently

When a private car hits you, the claim usually runs through a personal motor policy. When a work ute, van, truck or trades vehicle hits you, the at-fault vehicle is often covered by a commercial motor policy or a fleet policy. That changes three things: who you deal with, what paperwork is required, and how quickly decisions get made.

Commercial insurers handle a higher volume of claims and often have a dedicated recoveries or third-party team. They may ask for a statement, photographs, a police event number and proof of your vehicle's make, model and condition before they accept liability. That can slow the early stage, but it does not change the law.

In New South Wales, the decision in Arsalan v Rixon confirmed that a not-at-fault driver can recover the reasonable cost of a like-for-like replacement vehicle, including through credit hire, where the at-fault driver's insurer is liable. The fact that the other vehicle was a commercial one does not remove that entitlement. It just means the file may sit with a commercial claims team rather than a retail one.

If you were driving a prestige or performance car, a commercial insurer may initially offer a standard replacement through a rental partner. That offer is not the ceiling of your entitlement. You can ask for something that matches your car's size, specification and use. Our like-for-like guide explains how equivalence is assessed.

Getting the business name, ABN and insurer details at the scene

At the scene, the most valuable thing you can collect is information that identifies the at-fault business. A work ute often carries a business name on the door, a fleet number, or a logo. Photograph the vehicle from several angles, including the number plate, the signage and any damage.

Ask the driver for:

  • Their full name, licence number and mobile number.
  • The registered owner's name and ABN, if the vehicle is owned by a business.
  • The insurer name and policy number, if they have it.
  • The company name and worksite or depot they are returning to.

If the driver says the vehicle is owned by someone else, ask for the owner's name and contact details. A business vehicle may be driven by an employee, a subcontractor or a family member. The insurer will want to know who is responsible.

Take photographs of the scene, the road position, the weather and any skid marks. If there are witnesses, ask for their names and numbers. In Sydney, crashes on arterial roads like Parramatta Road, the M4, Military Road or the Pacific Highway often attract passing traffic; a witness who stops for thirty seconds may be the difference later.

Call the police if anyone is injured, if the other driver leaves, or if the vehicle is blocking traffic. For non-injury crashes, you can report online and get an event number. That number is useful when a commercial insurer asks for proof of the incident.

What to do if the driver is not the owner

Many work utes and vans are driven by someone other than the registered owner. An employee may be driving a company vehicle, a subcontractor may be driving a leased van, or a family member may be driving a business vehicle after hours. This does not change your right to a replacement car, but it does change who the insurer contacts.

If the driver is not the owner, get the owner's name and contact details. If the driver refuses, note the registration number and the business name on the vehicle. You can then ask the insurer to identify the policy. If the vehicle is unregistered or uninsured, you may need to pursue the driver or owner directly, and a solicitor can help.

In New South Wales, the Nominal Defendant scheme can assist in some cases where an uninsured or unidentified vehicle is involved, but it has strict time limits. If you are unsure, speak to a solicitor early.

For the replacement car itself, the key point is that your entitlement flows from the at-fault driver's liability, not from whether they own the vehicle. As long as fault is clear, a like-for-like replacement can proceed. Our first 24 hours guide sets out the steps in order.

Liability, admissions and what not to say

At the scene, be polite and factual. Exchange details, take photographs and avoid saying anything that could be read as an admission. Do not say "I didn't see you" or "I was in a hurry". Even a casual comment can be repeated in a claims file.

You do not need to argue about fault at the roadside. If the other driver admits fault, note what they said and to whom. If they deny it, do not push. The evidence will decide.

When you speak to the commercial insurer, stick to the facts: where you were, what you were doing, what happened, and what damage you can see. You are not obliged to give a recorded statement immediately. You can ask for the questions in writing or ask to speak to a solicitor first. Our dealing with insurers guide covers this in more detail.

If the insurer asks you to sign an authority or a release, read it carefully. Some documents authorise the insurer to deal with your repairer or to access your vehicle. You can agree to a repair authority without agreeing to a settlement of your hire car claim. If you are unsure, get advice.

Remember that liability is about the crash, not about the type of vehicle. A commercial insurer may try to argue that a ute is a work vehicle and therefore your replacement should be a basic one. That argument does not reflect the law. Your replacement should match the car you were driving.

Your entitlement to a like-for-like replacement

Like-for-like means a replacement that is comparable to your own car in size, specification, transmission, fuel type and prestige. If you were driving a Range Rover Sport, a small SUV is not like-for-like. If you were driving a performance car, a standard sedan is not like-for-like.

The assessment looks at:

  • Body type and seating capacity.
  • Engine and drivetrain, including whether it is all-wheel drive.
  • Transmission and fuel.
  • Boot or load space, if you use it for work or family.
  • Any specialist fit-out, such as a tow bar or roof racks.

If your exact model is not available, the replacement should be equivalent, not merely similar. Our equivalence assessment guide explains how this works for prestige cars.

For a prestige SUV, a comparable replacement might be a Range Rover Sport or a BMW X6. Both are available through the fleet, with delivery in Sydney. The rate, bond and any fees are shown on the car's page before payment.

If the commercial insurer delays

Commercial insurers sometimes take longer to accept liability because they need to confirm the driver was authorised, the vehicle was covered, or the incident falls within the policy. That delay can leave you without a car for longer than necessary.

You have options:

  1. Ask for the claim reference and the name of the claims officer handling the file.
  2. Provide all requested documents promptly: your licence, registration, photographs, police event number and a statement.
  3. Ask for a decision in writing within a set timeframe, such as five business days.
  4. If the delay continues, consider credit hire. Under a credit hire agreement, the replacement car is provided now and the cost is recovered from the at-fault insurer later. You may need to sign an agreement and provide information, but you do not pay upfront.

Credit hire is not for everyone, and it is important to understand the terms. Our how credit hire works page explains the process. If the insurer continues to delay, a solicitor can write to them. Our insurer disputes guide sets out the escalation steps.

Keep a record of every call, email and letter. Note the date, time, who you spoke to and what was said. If the matter ends up in a dispute, that record is valuable.

Delivery and collection around your work hours

If your car is off the road, you need a replacement that fits your schedule. Delivery is available on most cars in the fleet, and collection can be arranged when your car is repaired or when the hire ends.

In Sydney, delivery can be arranged to your home, your workplace or a repairer. Common delivery points include the CBD, Parramatta, Chatswood, Bondi, Sutherland and Penrith. If you work in the city and live in the Hills, you can choose the handover point that suits you.

For business fleets, delivery can be coordinated with your fleet manager or workshop. If you run a trades business and your ute is off the road, a replacement ute can be delivered to your depot or to a site. Our business and fleet page covers fleet replacements.

When you book, have your licence, a credit or debit card, and the claim details ready. The minimum driver age is 20 on most cars and 25 or 30 on some. The bond equals the excess you choose, and paying by card carries a small surcharge while bank transfer and cash on the rental do not. The rate, bond and any fees are shown on the car's page before payment.

If you need the car outside standard hours, ask. Early morning and evening handovers can often be arranged with notice.

When to bring in a solicitor

Most not-at-fault replacement car claims do not need a solicitor. If liability is clear and the insurer accepts it, the process can run smoothly. But there are situations where legal advice is worth getting early:

  • The at-fault driver denies fault or the insurer disputes liability.
  • The insurer refuses to provide a like-for-like replacement.
  • The other vehicle was unregistered or uninsured.
  • You were injured and are considering a personal injury claim.
  • The insurer asks you to sign a release or settlement document.
  • The hire car costs are disputed after the hire ends.

A solicitor can write to the insurer, negotiate on your behalf and, if necessary, issue proceedings. If you already have a solicitor for the crash, tell them about the replacement car so it can be included in the claim.

Smash repairers and brokers can also refer you to a replacement car provider. Our partners and referrals page explains how that works. If you are a repairer, keeping a replacement car option ready for customers helps them stay mobile and reduces pressure on your workshop.

Questions people ask

Does it matter that the at-fault vehicle was a work ute?
No. Your entitlement to a like-for-like replacement car comes from the at-fault driver's liability, not from the type of vehicle they were driving. A commercial insurer may handle the claim differently, but it cannot refuse a comparable replacement simply because the other vehicle was a ute or van. If liability is clear, you can proceed.
What details should I get from a commercial driver?
Get their name, licence number, mobile number, the registered owner's name and ABN, the insurer and policy number, and the business name on the vehicle. Photograph the vehicle, number plate and signage. If the driver is not the owner, ask for the owner's contact details. These details help the insurer identify the policy and speed up the claim.
Can I still get a prestige replacement car?
Yes. If you were driving a prestige or performance car, the replacement should match it in size, specification and prestige. A commercial insurer may initially offer a standard rental, but that is not the limit of your entitlement. You can ask for a comparable car, and credit hire can provide it while the claim is resolved.
What if the at-fault driver's insurer denies liability?
If liability is denied, gather your evidence: photographs, witness details, police event number and any dashcam footage. Ask the insurer for their reasons in writing. You can then respond with your evidence or ask a solicitor to write on your behalf. In some cases, credit hire can still proceed if your case is strong.
How long can I keep the replacement car?
You can keep the replacement car for the reasonable time your own car is off the road, including repair time or until a write-off settlement is reached. The hire should not run longer than necessary. Your provider will work with you and the insurer to set the end date.
Do I need to pay for the replacement car upfront?
Under a credit hire agreement, you do not pay upfront. The cost is recovered from the at-fault insurer later. You will need to sign an agreement and provide information. If you choose a standard hire instead, payment terms are shown on the car's page before you book.
